No person shall be employed or regularly assigned under any title not appropriate to the duties to be performed. In positions encompassing several duties of comparable levels of difficulty and requiring similar qualifications, the appropriate title will reflect the preponderant duties. In positions encompassing related duties of substantially varying levels of difficulty, the appropriate titling shall reflect the most difficult duties required if such duties are performed to a substantial degree.
The cooperation of each department head and division head is essential for maintaining the integrity of the classification plan by limiting employees to the performance of duties appropriate to their class, or notifying the Commission upon the assignment of inappropriate duties.
It shall be the duty of the Commission to study new positions or existing positions in which there is doubt as to the appropriate titling. The Commission shall amend as necessary the official classification to reflect the results of such studies. New descriptions and/ or specifications are subject to approval of the Commission.
The Commission shall review continually the appropriateness of the class titles assigned to each position in the classified service, and shall determine whether employees assigned to the unclassified service are filling positions which are or should be in the classified service, or whether employees in one class are performing duties regularly assigned to positions in other classes.
Incumbents holding permanent status in a position reclassified to a higher or different class, as approved by the Civil Service Commission, shall be automatically certified by the Commission to the reclassified position effective from the date of approval by the Civil Service Commission provided, however, that the incumbent has been performing the duties of the reclassified position for a period of twelve (12) consecutive months immediately preceding the date the reclassification is approved by the Civil Service Commission; and two, that the incumbent meets the basic requirements of the reclassified position.
In such action as described above, the Civil Service Commission shall require documentation from the immediate supervisor of the incumbent and/or that of the head of the division, agency or commission in which the position exists as to the length of time the incumbent has been performing the duties of the reclassified position. The Civil Service Commission may conduct further investigation and required such additional information as deemed necessary so as to establish to its satisfaction the incumbent's eligibility for automatic certification to the reclassified position.
Incumbents of positions reclassified to a classification having a lower level of responsibility shall be given an opportunity to return to a vacant position in the former classification. If a vacancy does not exist at such time, the name of the incumbent shall be placed on a re-appointment list by seniority for the former classification. An individual may decline one offer to return to the former classification and remain at current salary. An individual declining a second offer to return to the former classification shall have the rate of pay immediately reduced to the rate established by ordinance for the current classification, or to the red-circled rate of pay for the current classification whichever is higher.
The announcement by the Commission of an examination shall be officially advertised in the Toledo City Journal before the day set for the examination and shall invite qualified persons to make application for admission to the examination. Such notice shall contain a clear statement showing the following:
a. The title of the position for which the examination is to be held.
b. The duties of the position.
c. The minimum qualifications of education and experience required.
d. The designation of which classes shall be eligible to participate if the examination is promotional.
e. Age limits and physical requirements.
f. Residence requirements.
g. The salary ranges for the position.
h. The application filing period. Applications for continuous examinations will be accepted continuously unless so noted on the examination announcement.
i. The place where applications may be secured, the place where they must be filed and any other information that may be deemed necessary.
j. Licenses or certifications required.
If the examination is to be promotional, notices shall be distributed in advance of the examination date to each department and recognized employee bargaining group in which there are employees eligible to apply.
