1046.03 APPLICATION.
   An application for a permit shall be signed by the person, corporation, firm, company, installer or contractor who will perform the work of installing the sanitary sewer service connection. The application must describe the property and state specifically and exclusively, the fixtures to be connected.

1046.04 DEPOSIT REQUIRED.
   The applicant shall deposit in cash, official bank check or certified check, an amount to be fixed by the Commissioner of Buildings, sufficient to insure the proper installation of the sewer service connection and appurtenances and the replacing of pavements, other surfaces and property and/or utilities, both public and private, destroyed or damaged by, or as a result of, the construction. The amount of the deposit, however, shall not be less than three hundred dollars ($300.00) plus one dollar ($1.00) per square foot of excavation opening within a public roadway or easement.

1046.05 DISPOSITION OF DEPOSIT.
   In the event the permittee or his agent completes the work within the established time limit as established herein and faithfully and properly completes the work, including excavation, backfilling, compacting, repaving, restoring of surfaces, replacement of utilities and other damage or destroyed property and has not permitted earth, sand or other debris to enter the public sanitary sewer, the deposit shall be returned to the permittee. If, however, the permittee or his agent fails to properly complete the work and other items herein recited, within the established time limit, and/or has permitted earth, sand or other debris to enter the public sanitary sewer, then the City will undertake the completion of the work and any required cleaning of the public sanitary sewer and the cost of such work done by the City shall be deducted from the required deposit to cover the cost of all necessary labor, material and equipment. The balance of the deposit shall be returned to the permittee after completion of the work by the City.

1046.06 FILLING, PAVEMENT AND CURBING SPECIFICATIONS.
   All filling of required excavations within a public roadway shall consist of thoroughly compacted coarse sand. All roadway pavement replacement shall consist of high-early strength Class "D" concrete base or base and surface where such pavement exists. Where pavement consists of bituminous surfaced concrete or brick, the replaced base shall consist of high-early strength Class "D" concrete base and two inches of compacted plant mixed Type "B" asphaltic concrete. Where pavement consists of macadam or bituminous surfaced macadam, the pavement replacement shall consist of twelve inches of thoroughly compacted coarse stone macadam choked with fine stone and surfaced with two inches of compacted plant mixed Type "B" asphaltic concrete. All surfaces shall be finished even with existing surfaces. All cuts in pavements shall be straight and true and all joints shall be sealed with bituminous cement. Concrete pavement and pavement base shall be a minimum of nine inches in thickness. Concrete shall have a minimum cement content of six and one-half sacks per cubic yard and a minimum compressive strength of 4,200 pounds per square inch in fourteen days. Sidewalk and driveway pavements removed or damaged by the connection construction shall be replaced in strict accordance with established standards of the City. Curbing whether of stone or concrete shall be replaced to its original design section and shall be composed of the same mix concrete specified for pavement.

1046.07 TEMPORARY ROADWAYS; BARRICADES AND WARNING LIGHTS.
   The City may require that all open trenches or unfilled openings be covered by a metal plate or plates sufficient to maintain uninterrupted vehicular traffic within paved portions of public roadways and may further specify the type and number of barricades and warning lights as may be necessary to reasonably and adequately protect pedestrian and vehicular traffic against accidents.

1046.08 EFFECTIVE PERIOD OF PERMITS; MAXIMUM PERIOD FOR EXCAVATING.
   All permits shall be effective for a maximum period of thirty days. All work shall be promptly commenced and performed without any unnecessary or undue delay. Excavations shall not be allowed to remain in an open condition for any period longer than is reasonable or necessary to expeditiously complete the work and, in any event, not longer than thirty-two consecutive hours.

1046.09 RESPONSIBILITY OF PERMITTEE; INSURANCE.
   The full primary responsibility for any excavation shall be that of the permit applicant, who shall at all times keep the same properly guarded and enclosed so that the safety of persons and vehicles using the public roadway or easement will be assured. This responsibility shall continue until permanent replacement of pavements and all other surfaces to original status and condition is made and shall include the defense, settlement and payment of any and all claims, actions and court judgments for damages or injuries to anyone, arising in any way, out of the creation or maintenance of excavations by the permittee.
   The applicant for a permit shall deposit with the Commissioner of Buildings evidence of a public liability insurance policy, insuring the City against any loss or damage to persons or property resulting from or growing out of the work being done.
   The amount of such insurance shall be at least one hundred thousand dollars ($100,000) in case of injury or death of one person, and three hundred thousand dollars ($300,000) in case of injury or death of more than one person and, in case of property damage, the limits of liability shall be one hundred thousand dollars ($100,000) for one accident with a total aggregate liability of three hundred thousand dollars ($300,000). All policies shall be subject to the approval of the Law Director.
