(A) Any person who violates any of the provisions of this traffic code for which no other penalty is provided shall be guilty of a violation and shall be fined not less than $10 nor more than $100 for each offense.
(C) Every person convicted for violation of § 70.07 shall be guilty of a misdemeanor and shall be punished upon a first conviction by imprisonment for a period of not less than 5 days nor more than 90 days, or by a fine of not less than $25 nor more than $500, or by both such fine and imprisonment, and on a second or subsequent conviction shall be guilty of a misdemeanor and shall be punished by imprisonment for not less than 10 days nor more than 6 months, or by a fine of not less than $50 nor more than $500, or by both such fine and imprisonment.
(D) Nothing in this division or in §§ 70.06, 75.03, 75.04, 75.05, 75.07, or 75.08 shall be deemed to prejudice or affect the authority of the city to suspend or revoke certificates of common carriers, permits of contract carriers, or driver's or chauffeur's licenses, for any violation of these sections or any other act applicable to motor vehicles, as provided by law.
(E) Every person who commits, attempts to commit, conspires to commit, or aids or abets in the commission of, any act declared by §§ 70.06, 75.03, 75.04, 75.05, 75.07, or 75.08 to be a crime, whether individually or in connection with one or more other persons or as a principal, agent, or accessory, shall be guilty of such offense, and every person who falsely, fraudulently, forcibly, or willfully induces, causes, coerces, requires, permits, assists, or directs another to violate any provision of these sections is likewise guilty of the offense.
(F) Any person who violates § 70.12 shall be guilty of a misdemeanor and shall be fined not less than $100 nor more than $500.
(J) If a member of a regular or voluntary fire department or rescue squad violates § 71.07 he shall, in addition to any other penalty, be immediately dismissed from his membership or employment with the fire department or rescue squad and shall be disqualified from being employed by or being a member of the fire department or rescue squad in the city for a period of 3 years. Upon conviction of a second offense he shall be permanently barred from employment or membership in any fire department, rescue squad, or police department in the city, nor shall he be permitted to operate any public safety vehicle.
(K) Any person who violates § 71.08 shall be guilty of a misdemeanor and shall be fined not less than $50 nor more than $1,000 or be imprisoned in the county jail for not more than 6 months, or both. In the case of a private vehicle, all lighting and other equipment used in violation of §§ 71.05 through 71.08, 72.04, and 72.05, shall be confiscated and forfeited to the county.
(M) Any person who violates §§ 71.18, 71.42 (A), or 70.60 shall be guilty of a misdemeanor and shall be fined not less than $20 nor more than $100 for each offense. A violation of § 71.42 (A) shall be punished, in the alternative, by imprisonment in the county jail for not more than one year or both fine and imprisonment.
(P) Any person who violates § 71.36 shall be guilty of a violation and shall be fined not more than $5 in excess of the cost of the repair of the road.
(Q) Any person who violates § 71.37 shall be guilty of a misdemeanor and shall be fined not less than $50 nor more than $200 or be imprisoned for not more than 30 days, or both.
(R) Any person who violates § 71.38 shall be guilty of a violation and shall be fined not less than $10 nor more than $50.
(S) (1) Any person who violates § 71.39 (B) shall be guilty of a misdemeanor and shall be fined, for the first offense, not less than $100 nor more than $500; for the second offense, a fine of not less than $100 nor more than $500 and imprisoned for not less than 3 days nor more than 6 months; for each subsequent offense he shall be fined not less than $100 nor more than $500 and imprisoned for not less than 30 days nor more than 12 months.
(2) Any peace officer who violates § 71.39 (C) shall be guilty of a violation and shall be fined not less than $25 nor more than $100.
(T) Any person who violates § 71.41 shall be guilty of a misdemeanor and shall be fined not less than $25 nor more than $100 or imprisoned not less than 30 days nor more than 12 months, or both.
(U) (1) Any person who violates any of the provisions of § 71.44 shall be guilty of a misdemeanor and shall be fined not less than $15 nor more than $200, or imprisoned for not more than 30 days, or both.
(2) In addition to the penalties prescribed in division (l), in case of violation by any person in whose name the vehicle used in the transportation of inflammable liquids or explosives is licensed, such person shall be guilty of a misdemeanor and shall be fined not less than $100 nor more than $500. Each violation shall constitute a separate offense.
(V) Any law enforcement agency which fails or refuses to forward the reports required by § 71.51 shall be subject to the penalties prescribed in KRS 17.157 (2).
(W) Any person who violates § 72.04 shall be guilty of a violation and shall be fined not less than $100 nor more than $500, or imprisoned in the county jail for not more than 30 days or both. In the case of a private vehicle, all lighting and other equipment used in violation of §§ 71.05 through 71.08, 72.04, and 72.05 shall be confiscated and forfeited to the county in which the offense occurred.
(X) Any person who violates § 72.05 shall be guilty of a misdemeanor and shall be fined not less than $100 nor more than $1,000 or be imprisoned in the county jail for not more than 30 days, or both. In the case of a privately owned vehicle, all lighting and other equipment used or installed in violation of §§ 71.05 through 71.08, 72.04, and 72.05 shall be confiscated and forfeited to the county in which the offense occurred.
(Z) (1) Any person who violates § 72.23 (A) shall be guilty of a violation and shall be fined not more than $5.
(2) Any person who violates § 72.24 shall be guilty of a violation and shall be fined not less than $25 nor more than $200.
(AA) (1) Any person who violates § 72.27 (A) shall be guilty of a violation and shall be fined not less than $15 nor more than $100.
(2) Any peace officer who fails, when properly informed, to enforce § 72.27 shall be guilty of a violation and shall be fined not less than $15 nor more than $100.
(3) All fines collected under this division, after payment of commissions to officers entitled thereto, shall go to the county road fund if the offense is committed in the county, or to the city street fund, if committed in the city.
(BB) A person who elects to operate a bicycle in accord with any regulations adopted pursuant to § 73.05 and who willfully violates a provision of such a regulation shall be guilty of a violation and shall be fined not more than $100. A person who operates a bicycle without complying with any regulations adopted pursuant to § 73.05 or vehicle safety statutes shall be prosecuted for violation of the latter.
(CC) Any person who violates the weight provisions of §§ 75.03, 75.04, 75.09. 75.11, and 75.12 shall be guilty of a misdemeanor and shall, upon conviction, be fined in an amount equal to $.02 per pound for each pound of excess load when the excess is 2,000 pounds or less, $.03 per pound when the excess exceeds 2,000 pounds and is 3,000 pounds or less, $.05 per pound when the excess exceeds 3,000 pounds and is 4,000 pounds or less, $.07 per pound when the excess exceeds 4,000 pounds and is 5,000 pounds or less, and $.09 per pound when the excess exceeds 5,000 pounds but in no case shall the fine be less than $50 nor more than $500.
(DD) The railway companies or corporations shall, for each day they fail to comply with the provisions of §§ 75.27 or 75.28, be subject to a fine of $20 for each grade crossing referred to. Any person, firm, or corporation violating any provision of §§ 75.27 or 75.28 shall be guilty of a misdemeanor and shall be fined not less than $5 nor more than $25 for each offense.
(FF) Any person, firm, or corporation violating § 75.31 shall be guilty of a violation and shall be fined not less than $5 nor more than $100 or confined in the county jail for not less than 5 nor more than 90 days or both fine or imprisonment, for each offense.
(GG) A violation of any provision of § 75.33 shall be guilty of a violation and shall be punishable by a fine of not less than $10 nor more than $30.
(HH) Whoever violates any provision of § 71.42(G) shall be guilty of a violation and shall be fined not less than $75 nor more than $100. Each day's continued violation shall constitute a separate offense.
