As used in this ordinance, the terms defined in this section shall have the following meanings unless the context clearly indicates another meaning:
BUILDING: A combination of materials, whether portable or fixed, which comprises a structure affording facilities or shelter for any use of occupancy, and shall include a part or parts thereof and all equipment therein normally a part of the structure.
BUILDING INSPECTOR: The person so designated by the mayor and with the advice and consent of the Cascade city council.
BUILDING SITE: Any lot, tract, parcel, or subdivision of land, either public or private, upon which a building is placed or is to be placed.
CLOSED CONSTRUCTION: Any building, building component, assembly or system manufactured in such a manner that all concealed parts or processes of manufacture cannot be inspected before installation at the building site without disassembly, damage or destruction.
COMMERCIAL COACH: A factory assembled structure equipped with the necessary service connections and made so as to be readily movable as a unit on its own running gear and originally designed to be used either as a dwelling unit or other use without a permanent foundation.
CONSTRUCTION: The erection, fabrication, reconstruction, demolition, alteration, conversion, or repair of a building (other than in-kind), or the installation of equipment therein normally a part of the structure.
EQUIPMENT: Facilities or installations including, but not limited to, heating, ventilating, air conditioning, and refrigerating facilities or installations, and elevators, dumbwaiters, escalators, boilers and pressure vessels and ski lifts, but not including telecommunications facilities.
FARM: An agricultural unit of five (5) acres or more.
HUMAN HABITATION: When used in respect to temporary facilities, means a space in a structure for living, sleeping, eating or cooking. Bathrooms, toilet compartments, storage or utility space and similar areas are not considered space for human habitation.
LOCAL GOVERNMENT: The city of Cascade, Idaho.
MANUFACTURED BUILDING: Any building which is of closed construction and which is made or assembled in manufacturing facilities, on or off the building site, for installation, or assembly and installation, on the building site.
PERSON: A natural person, corporation, partnership, trust, society, club, association, or other organization.
TELECOMMUNICATIONS FACILITIES: All wires, cables, equipment, apparatus or other installations necessary to furnish service, by which there is accomplished or may be accomplished, the sending or receiving of information, data, message writing signs, signals, pictures, and sounds of all kinds, by aid of such wires, cables, equipment, apparatus or other installations, but shall not include the habitable structure in which such telecommunications facilities are housed.
TEMPORARY FACILITY: A structure designed and constructed to service actual construction projects and which is completely removed upon completion of the project. This structure shall not be a place of employment or human habitation, and does not include those temporary structures used for the protection of the public around and in conjunction with construction work. The approved editions of the following nationally recognized codes, for the adoption of subsequent editions of the code, except as herein amended, as adopted by the state of Idaho or the Idaho building code board together with any amendments or revisions to the Idaho building code made by the Idaho building code board through the negotiating rulemaking process are hereby adopted by reference for all areas within the incorporated limits of Cascade, Idaho, unless otherwise amended by ordinance of the city council:
The 2012 edition of the international building code or as subsequently amended;
The 2009 edition of the international residential code or as subsequently amended;
The 2012 edition of the international existing building code;
The 2009 edition of the international energy conservation code or as subsequently amended;
The 2009 edition of the international fire code or as subsequently adopted by the Idaho state fire marshal with the administrative rule of IDAPA 18.01.50;
All provisions of the Idaho Code related to building safety and inspection as currently and subsequently adopted. (Ord. 670, 2-10-2014)
As such codes above enumerated are amended, changed or altered, such amendments, changes and alterations as adopted by the state of Idaho or the Idaho building code board together with any amendments or revisions to the Idaho building code made by the Idaho building code board through the negotiating rulemaking process are hereby adopted and made a part of the Cascade building code. The code is hereby declared to be as adopted by the state of Idaho or the Idaho building code board together with any amendments or revisions to the Idaho building code made by the Idaho building code board through the negotiating rulemaking process published by the International Conference Of Building Officials, and is hereby amended in the following respects:
(A) Snow Loads: R301.6 The design snow load for the city of Cascade shall be 100 lbs. per square foot. The basic design snow loads shall be determined by the procedure provided in the 1986 University Of Idaho Snow Load Publication "Ground And Roof Snow Load For Idaho".
(B) International Residential Code: Section R403.1.4 be amended by adding "Minimum depth for all exterior footings shall be placed at least 24 inches below grade".
(C) Manufactured Homes Installation Permits: Placement of mobile/manufactured homes shall require an installation permit. The permit applicant shall supply to the building inspector the same site information required from an applicant seeking a building permit for a single family dwelling and shall pay a permit fee as set by resolution of the city council. Snow loads for manufactured homes are 100 lbs. per square foot. If snow loading is not met by the manufacturer, a ramada (snow roof cover) may be placed over manufactured home to meet snow load requirements. The moving of mobile/manufactured homes into a recreational vehicle or trailer park, where a ramada is not permitted to be built, a letter is required from the homeowner for maintenance of snow removal from the roof. This letter shall be provided before issuance of the permit.
(D) International Residential Code: Section R105.2(1) be amended as: One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 200 square feet shall require a building permit for placement requirements established by zoning regulations. The building permit placement fee is set by resolution of the city council.
(E) Demolition of any building, residence or structure shall first obtain a building permit authorizing such work to be done and permit fee is set by resolution of the city council.
(F) IBC Building Code Amendment, Table 2902.1 Footnote f: f. Drinking fountains are not required for an occupant load of thirty (30) or fewer.
(G) IBC Building Code Amendment, Table 2902.1 Footnote g: g. For business occupancies, excluding restaurants, and mercantile occupancies with an occupant load of thirty (30) or fewer, service sinks shall not be required.
(H) IRC Building Code Amendment, Section R315.3 - Carbon Monoxide Alarms Where Required In Existing Dwellings: R315.3 Where Required In Existing Dwellings. Where work requiring a permit occurs in existing dwellings that have attached garages or in existing dwellings within which fuel-fired appliances exist, carbon monoxide alarms shall be provided in accordance with section R315.1. Exceptions: 1. Work involving the exterior surfaces of dwellings, such as, but not limited to, replacement of roofing or siding, or the addition or replacement of windows or doors, or the addition of a porch or deck, or electrical permits, are exempt from the requirements of this section. 2. Installation, alteration or repairs of noncombustion plumbing or mechanical systems are exempt from the requirements of this section.
(I) IRC Building Code Amendment, Section N1102.4.3, Fireplaces: N1102.4.3, Fireplaces. New wood-burning fireplaces shall have tight-fitting flue dampers and outdoor combustion air.
(J) IECC Energy Code Amendment, Section 402.4.3, Fireplaces: 402.4.3, Fireplaces. New wood-burning fireplaces shall have tight-fitting flue dampers and outdoor combustion air.

(A) Structures of two hundred (200) square feet or less, of floor space for wood storage or other structures not constructed for human habitation or occupancy, shall not be required to meet the snow load provisions of subsection 2-1-7(A) of this chapter; (Ord. 660, 5-28-2013)
(B) That the city, its elected officials, agents, employees and servants shall not be liable in any manner for loss sustained by any permit holder constructing a structure under a permit obtained pursuant to the provisions of this section;
(C) No building permit shall be issued under the provisions of this section until the applicant first executes and delivers to the city a general release, releasing the city, its elected officials, agents, employees and servants from any and all loss or damage that may be sustained by a permit holder by reason of the issuance of such permit or the construction of any structures thereunder. One copy of each of the codes enumerated in section 2-1-5 of this chapter duly certified by the city clerk, are on file for use and examination by the public in the office of the city clerk of Cascade, Idaho. (Ord. 660, 5-28-2013)
