§ 14.02 DEFINITIONS.
   The following words and terms, when used in this Article I, shall have the following meanings unless the context clearly indicates otherwise.
   ISSUING AUTHORITY. The City of Bloomington License Section, Building and Inspection Division, Environmental Services Division or City Fire Marshal.
   LICENSE PREMISES. The premises described in the approved license or permit application.
   PERSON. One or more natural persons; a partnership, including a limited partnership; a corporation, including a foreign, domestic or nonprofit corporation; a trust; a political subdivision of the state; or any other organization.
   SALE or SELL. All barters and all manners or means of furnishing a product or service for compensation or renumeration.

§ 14.03 FEES.
   Except as otherwise stated in this code, the fees for the various licenses and permits shall be as set forth in City Code Appendix A.

§ 14.04 LICENSE OR PERMIT APPLICATION.
   Applications for licenses, permits and renewals shall be made in writing to the . The applications shall request the following:
   (a)   The type of license or permit the applicant seeks;
   (b)   The name and address of the applicant and whether the applicant is a natural , a partnership, a corporation or other type of organization;
   (c)   The name and address of the location or place of business for which the license or permit is requested, if applicable, and the general kind of business carried on at the address; and
   (d)   Such other information as the City Council or shall require.

§ 14.05 LICENSE OR PERMIT APPLICATION EXECUTION.
   Unless a specific article or division of this chapter provides otherwise, if the application for a license or permit is that of a natural , the application shall be signed and sworn to by that ; if of a corporation, by an officer thereof; if of a partnership, by one of the general partners; if of an unincorporated association, by the manager or managing officer thereof.

§ 14.06 LICENSE OR PERMIT APPLICATION VERIFICATION.
   Unless a specific article or division of this chapter provides otherwise, applications for licenses or permits shall be submitted to the . In order to protect the health, safety and welfare, the is empowered to conduct any and all investigations to verify the information on the application, including ordering a computerized criminal history inquiry and/or a driver’s license history inquiry on the applicant.

§ 14.07 LICENSE OR PERMIT APPLICATION CONSIDERATION.
   (a)   Application process. Unless a specific procedure is detailed in a separate article or division of this chapter, all licenses or permits shall be granted or denied by the following the submission of a fully completed application and after the has conducted the necessary application verification. If a license or permit is denied, the shall notify the applicant in writing by regular mail of the applicant’s right to appeal the decision to the City Council within 20 days after the date of the notice to the applicant. If an appeal is timely made by the applicant, a hearing before the City Council shall be scheduled within a reasonable period.
   (b)   Master license or permit. Upon approval of a license or permit, the shall issue a master license to include each licensed category, if appropriate. Supplemental licenses for each category shall be prorated monthly to coincide with the renewal date of the master license. Except as may otherwise be specifically provided in this chapter, all licenses and permits issued under this chapter shall terminate one year from the date of issuance of the license or permit as indicated on the official license or permit document.

§ 14.08 PERSONS AND LOCATIONS INELIGIBLE FOR LICENSE AND PERMIT.
   (a)   Persons ineligible. Unless a specific article or division of this chapter provides otherwise, no license or permit in this code shall be granted if the applicant, including any on behalf of whom the application is filed:
      (1)   Is not a citizen of the United States or a resident alien, or does not have the legal authority to work in the United States;
      (2)   Is not of good moral character or repute;
      (3)   Has had a conviction of any crime that is directly related to the occupation or business being licensed or permitted, as prescribed by M.S. § 364.03, subd. 2, as it may be amended from time to time, and the applicant has not shown competent evidence of sufficient rehabilitation and present fitness to perform the duties of the occupation or business as prescribed in M.S. § 364.03, subd. 3, as it may be amended from time to time;
      (4)   Is not the real party in interest in the business, occupation or development being licensed or permitted;
      (5)   Has knowingly misrepresented or falsified information on the license or permit application;
      (6)   Owes taxes or assessments to the state, county, school district or city that are due and delinquent;
      (7)   Has failed to comply with all relevant statutory, City Charter and ordinance requirements;
      (8)   Has failed to pay all fees, charges or other debts or obligations which are due from the applicant and payable to the city regarding any matter; and
      (9)   Is not in compliance with all ordinance requirements and conditions regarding other city approvals which have been granted to the applicant for any matter. The may require the removal of nonconforming structures or site characteristics as a condition of a permit, license or Zoning and Building Code approval. Additional requirements for nonconforming structures or site characteristics are set forth in § 21.504 of this code.
      The requirements of subsections (a)(8) and (a)(9) above may be waived if enforcement thereof would result in a significant hardship to the applicant through no fault of the applicant or would result in an otherwise unfair situation.
   (b)   Locations ineligible. Unless a specific article or division of this chapter provides otherwise, no license or permit in this code shall be granted to the following locations.
      (1)   Taxes due on property. No license or permit shall be granted or renewed for operation on any property on which taxes, assessments or other financial claims of the state, county, school district, or city are past due, delinquent or unpaid. In the event a suit has been commenced under M.S. §§ 278.01 through 278.13, as they may be amended from time to time, questioning the amount or validity of taxes, the City Council may on application waive strict compliance with this provision; no waiver may be granted, however, for taxes or any portion thereof which remain unpaid for a period exceeding one year after becoming due.
      (2)   Authorized use. No license or permit shall be granted unless the use for which a license or permit is being sought is authorized pursuant to Chapter 21 of the city code.
