§ 38.04 SCHEDULE OF VIOLATIONS.

   (A)   The following schedule of ordinances (hereinafter "Ord.") and City of Rochester, Code of Ordinances provisions shall be subject to the jurisdiction of the Ordinance Violations Bureau or the Superior Court of Fulton County and the first violations within a calendar year of said ordinances and code provisions shall be subject to the civil penalty set forth:

   (B)   This division (B) applies where penalties for multiple offenses are not addressed in the schedule in division (A) above. The second admission of a violation of the same ordinance or code provision of one scheduled above within a calendar year shall be subject to the penalty set forth above plus $5.00 as the total civil penalty. Any third admission of a violation of the same ordinance or code provision of one scheduled above within a calendar year shall be subject to the penalty set forth above plus $10.00 as the total civil penalty.
