§ 92.01 OPEN BURNING PROHIBITED.
   It shall be unlawful for any person to engage in the open burning of any matter or material within the city limits, with the following exceptions:
   (A)   Residents of the city may burn charcoal and/or wood in outdoor fireplaces and grills provided that the fireplaces or grills shall be placed in such a location as to be reasonably removed from any neighboring residence so as to avoid any smoke or fumes therefrom becoming a nuisance for any adjacent neighbor.
   (B)   In the event that there are such unusual circumstances as to make the burning of a substantial amount of combustible matter desirable, any person wishing to burn any such material shall apply to the Clerk-Treasurer for permission to burn such combustible material. Any such applications shall be considered by the Board of Public Works and Safety and if authorized by them any such burning will be done under the supervision of the City Fire Department.
