A. Fee: The annual fee to collocate a small wireless facility on a Village-owned utility pole located in a right-of-way shall be the higher of:
1. Two hundred dollars ($200.00)/year per small wireless facility; or
2. The actual, direct, and reasonable costs related to the wireless provider's use of space on the pole.
B. Exception: Small wireless facilities collocated on Village- owned utility poles located outside of public right-of-way are not subject to the rate limitations in this section.
C. License Agreement: Within thirty (30) days after an approved permit to collocate a small wireless facility on a Village utility pole, the Village and the applicant shall enter into a license agreement in a form provided by the Village for the initial collocation on a Village utility pole by the applicant. For subsequent approved permits to collocate on a small wireless facility on a Village utility pole, the Village and the applicant shall enter into a supplement to the license agreement.
