(a) No person shall dump or unload or cause to be dumped or unloaded from any vehicle any dry and dusty substance or material of any type which may be blown by the wind or may drift so that other persons may suffer damage or annoyance therefrom, without first taking proper precautions to prevent such damage or annoyance by wetting such substance down, enclosing the same or taking other proper precautions.

(b) Whoever violates this section is guilty of a misdemeanor of the third degree and shall be subject to the penalty provided in Section 698.02.
