6-1-4: DUTIES AND CONDUCT OF OFFICERS AND PERSONNEL:
   A.   It shall be the duty of all sworn officers to see to the enforcement of all village ordinances and laws of the state and the United States Of America, to preserve order, to prevent infractions of the law, and to arrest violators thereof. Every sworn officer shall serve subject to the orders of his superior officers and the chief of police. Every sworn officer is hereby declared to be a conservator of the peace, and every sworn officer shall avoid the use of unnecessary force and shall act in a lawful manner at all times.
   B.   It shall be the duty of all sworn officers and of all other employees of the police department to conduct themselves in a proper and law abiding manner at all times and to obey the orders and directions of their superiors and of the chief of police. (Ord. 982, 6-4-1990)
6-1-5: CAPTAIN:
   A.   Duties And Responsibilities:
      1.   Under the direct supervision of the chief of police, the captain shall coordinate, evaluate, and oversee the work activities, duties, and conduct of all sworn officers and civilian employees within the police department. Above and beyond his duties as a sworn officer, he shall interpret and assure adherence to department policies and procedures; resolve at one step employee work grievances; and administer appropriate corrective discipline. He shall review, approve, and maintain records, reports, and files of pertinent information.
      2.   The captain shall maintain and evaluate training within the department and review and evaluate work performance. He shall maintain liaison with local, state, and federal law enforcement agencies. In the absence of the chief of police, the captain may assume administrative duties of the position.    B.   Compensation: The captain shall be compensated at twice the rate of the sergeant as set forth in the collective bargaining agreement entered into between the village of Milan and the Illinois Fraternal Order Of Police Labor Council, Blackhawk Valley Lodge No. 219, as amended from time to time. The captain shall also be entitled to receive the same benefits to which all other employees of the Milan police department are entitled to under the terms of the said collective bargaining agreement. 6-1-6: DUTIES AND RESPONSIBILITIES OF SERGEANT:
Under the direct supervision of the captain, the sergeant(s) performs routine first line supervision and special tasks and assignments. Above and beyond his duties as a sworn officer, he is responsible for the supervision and direction of sworn subordinate officers and civilian personnel in their duties and conduct and in the day to day function and operation of the police department. The sergeant(s) shall maintain discipline, assure adherence to policies and procedures of the department, review activities and reports, and identify and report problem areas of concern. 6-1-7: DUTIES AND RESPONSIBILITIES OF INVESTIGATOR:
Under the direct supervision of the captain, the investigator shall perform investigations as assigned and prepare and file appropriate reports. In addition to the duties as investigator, the investigator shall perform the regular duties of a sworn officer. In the absence of a sergeant, the investigator will assume the duties of the sergeant. 6-1-8: SERVING PROCESS:
No sworn police officer, other than the chief of police, shall serve any process, except on command of the chief of police. (Ord. 982, 6-4-1990)
6-1-9: SERVE AS WITNESS; FEE:
Every sworn officer shall appear as witness whenever necessary in a prosecution for a violation of any village ordinance or of any state or federal law. No such officer shall retain any witness fee for service as a witness in any action or suit to which the village is a party or in which his testimony is based on the performance of his duties as an officer of the police department. Any fees for such services shall be turned over to the chief of police who shall deposit them with the village clerk. (Ord. 982, 6-4-1990)
