§ 860.01 DEFINITIONS.
   As used in this chapter, “hawker,” “peddler” and “huckster” shall be considered synonymous and mean a person engaged in the business of making sales of provisions, goods, wares or merchandise of any description upon the streets, alleys, public places and ways of the city, whether by personal solicitation or by supplying a purchaser with the provisions, goods, wares or merchandise without solicitation. A hawker, peddler or huckster shall be deemed to be such within the meaning of this chapter when he or she has no established place of business in the city and carries his or her provisions, goods, wares or merchandise with him or her for the purpose of selling the same.

§ 860.02 LICENSE REQUIRED; EXCEPTIONS.
   No person as a hawker, peddler or huckster shall sell or offer to sell, whether by himself or herself or through others, on any of the streets, alleys, public places or ways in the city, any provisions, goods, wares or merchandise of any description without first obtaining a license therefor from the Director of Finance. However, this chapter shall not apply to persons selling by sample only, to persons soliciting orders for future delivery, to persons selling products of their own hands, to the sale of goods imported from other states or foreign countries and sold in unbroken packages, to the sale of agricultural products offered or exposed for sale by the producer or to a person selling provisions, goods, wares or merchandise produced or manufactured in the county.
§ 860.03 LICENSE APPLICATION.
   Each applicant for a license required by this chapter shall file, in writing, an application for the same on a form to be furnished by the Director of Finance and shall set forth the name and residence of such applicant and the articles he or she intends to sell thereunder. If the articles to be sold are such as are usually sold by weight or measure, the applicant shall file with this application a certificate of the County Sealer of Weights and Measures that his or her scales, weights and measures have within 30 days prior to the filing of such application, been examined, found correct and duly sealed by the County Sealer. The Director may require any applicant to make an oath or solemn affirmation to the facts stated in the application.
