§ 119.999 PENALTY.
   (A)   Generally. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.999.
   (B)   Restaurants. Any person, firm or corporation who or which shall violate any of the provisions of §§ 119.001 through 119.008, or shall fail to comply with the same, upon conviction thereof, be punished by a fine of not less than $10 nor more than $100, together with costs of prosecution, or by imprisonment in the Wayne County Jail for a period of not more than 90 days, or by both a fine and imprisonment, in the discretion of the court trying the offender. In case any corporation shall be fined under the provisions of §§ 119.001 through 119.008 it shall be lawful to collect the fine and costs in an action of assumpsit to be brought in any court of competent jurisdiction.

   (C)   Sale of tainted meat, vegetables and other foodstuffs.
      (1)   Every person, firm or corporation convicted of violating the provisions of §§ 119.050 through 119.053 shall be punished by a fine of not to exceed $100 and costs of prosecution, and, in default of the payment of the fine and costs, the court may make a further sentence that the offender by imprisoned in the Wayne County Jail, or another place of imprisonment as may be hereafter established by the City Council of city as a place of confinement, until the fine and costs be paid, but not longer than 90 days, or, in the discretion of the Court having jurisdiction of the cause, both a fine and imprisonment may be imposed.
      (2)   In the event that there shall be imposed upon a corporation any fine and costs, or either, or both, for the violation of any of the terms of §§ 119.050 through 119.053, then it shall be lawful to collect the fine and costs, or either, or both, in an action of assumpsit before any court of competent jurisdiction.

   (D)   Sale of fresh meat or smoked meat. Every person, firm or corporation convicted of violating the provisions of §§ 119.065 through 119.075 shall be punished by a fine of not to exceed $100 and costs of prosecution, and, in default of the payment of the fine and costs, the court may make a further sentence that the offender by imprisoned in the Wayne County Jail, or another place of imprisonment as may be hereafter established by the City Council as a place of confinement, until the fine and costs be paid, but not longer than 90 days, or, in the discretion of the Court having jurisdiction of the cause, both a fine and imprisonment may be imposed. In the event that there shall be imposed upon a corporation any fine and costs, or either, or both, for the violation of any of the terms of §§ 119.065 through 119.075, then it shall be lawful to collect the fine and costs, or either, or both, in an action of assumpsit before any court of competent jurisdiction.

   (E)   Sale of food to the public in bulk. Any person, firm, corporation, copartnership or association convicted of violating any of the provisions of §§ 119.090 through 119.099 shall be punished by a fine not to exceed $100 and costs of prosecution, or by imprisonment in the Wayne County Jail, or another place of confinement as may be hereafter designated by the City Council, for a period not to exceed 90 days, or both a fine and imprisonment at the discretion of the court. In the event that there shall be imposed upon any corporation any fine and costs, or either, or both, for the violation of any of the terms of §§ 119.090 through 119.099, then it shall be lawful to collect the fine and costs, or either, or both, in an action of assumpsit before any court of competent jurisdiction.

   (F)   Sale of food supplies and food product at retail. Every person, firm, corporation, association or copartnership who or which shall violate or fail to comply with the provisions of §§ 119.110 through 119.114 shall upon conviction thereof, be punished by a fine of not to exceed $100 and costs of prosecution and, in default of the payment of the fine and costs, the court may make a further sentence that the offender be imprisoned in the Wayne County Jail, or another place of imprisonment as may be hereafter designated by the City Council as a place of confinement, until the fine and costs be paid, but not longer than 90 days, or, in the discretion of the court having jurisdiction of the cause, both the fine and imprisonment may be imposed. In the event that there shall be imposed upon a corporation any fine and costs, or either, or both, for the violation or failure to comply with the terms of §§ 119.110 through 119.114, it shall be lawful to collect the fine and costs, or either, or both, in an action of assumpsit before any court of competent jurisdiction.

   (G)   Poultry. Any violation of or failure to comply with the provisions of §§ 119.155 through 119.172 shall be punished by a fine of not to exceed $100 and costs of prosecution, or by imprisonment in the city prison, Wayne County Jail, or any workhouse in the state authorized to receive prisoners from the city, for not to exceed 90 days, or by both a fine and imprisonment, in the discretion of the court.

   (H)   Bakery. Any person, firm or corporation who shall violate any of the provisions of §§ 119.185 through 119.188 or fail to comply with the same shall, upon conviction thereof, be punished by a fine of not more than $100 or by imprisonment far not more than 90 days in the Wayne County Jail, or by both a fine and imprisonment in the discretion of the court. In case of the conviction of any corporation of the violation of the terms of §§ 119.185 through 119.188, the amount of the fine and costs imposed upon a conviction, together with the costs of same, may be collected in an action of assumpsit in any court of competent jurisdiction.

   (I)   Food handler card. Any person, firm, association or corporation, who violates any of the provisions of §§ 119.200 through 119.203 shall be prosecuted and upon conviction of the violation shall be guilty of misdemeanor and punished by a fine not exceeding the sum of $100 or by imprisonment in the Wayne County Jail, or another place of confinement as may be hereafter, establishment by the City Council, not exceeding 90 days, or both a fine and imprisonment in the discretion of the court having jurisdiction of the cause.
