RULE 1. The following bylaws, rules and regulations as established by the Village Administrator and adopted by Council are for the information and guidance of all users of the public water supply of the Village and are part of the contract between the Utility Department and each user, the owner of premises where water is furnished, applicants for water service and line extensions.
RULE 2. The public water supply system of the Village, including all water mains, laterals, valves, hydrants, meters and services, is under the exclusive control of the Village Administrator and the Utility Supervisor and their authorized agents and employees. Such control shall include all piping from the Village mains to the point of ultimate consumption or where the Village water is finally discharged freely at atmospheric pressure.
RULE 3. No person or firm shall make or maintain physical connection between any other source of water or liquid and the public supply piping. No spigot nor outlet shall be physically connected to a drain or sewer, nor shall such be below a free overflow or submerged.
RULE 4. Any person, firm or corporation having a connection to the public water supply system who permits public water to be wasted from such connection either by unnecessary use or to prevent freezing, or fails to prevent such wastage shall have, after personal notification, such water connection turned off. The Village Administrator and the Utility Supervisor may order water to be discharged from a spigot on any premises where insufficient heating facilities cause danger of freezing to lines.
RULE 5. No person, other than authorized agent of the Utility Department may connect to any public waterline, tamper with or remove any meter or parts thereof, or any seal, or insert a meter by-pass without permission of the Village Administrator or Utility Supervisor under penalty provided in Section 541.04
and 545.19
of the General Offenses Code, and also under penalty of having water service discontinued.

RULE 6. If the Water Department finds that a meter seal has been broken, a connection installed ahead of the meter, or any by-pass inserted or there is evidence that the meter has been tampered with, the water will be shut off and shall not be turned on again until the consumer or owner of the premises pay for the estimated quantity of water which has been used. and not registered, and in addition thereto, a fee of twenty-five dollars ($25.00) for turning on the water. The criminal laws of the State and ordinances of the Village provide severe penalties for tampering with water meters, meter seals, valves and other devices in the water system. The penalties hereinabove provided are in addition to the penalties provided by the criminal laws of the State and ordinances of the Village and the payment of the penalties hereinabove mentioned will not in any way relieve any person from criminal prosecution.
RULE 7. No person shall operate, open or otherwise tamper with any valve, corporation stop, curb stop or any device, after the same has been closed for the violation of any rule or regulation of the Utility Department, or unlawfully secure a supply of water through such corporation stop, curb stop, valve or other device after the same has been closed for the violation of any rule or regulation of the Utility Department or in any way take water for private use unlawfully or without first having secured the necessary permit from the Village Administrator.

RULE 8. Every water service from a public or private source will be equipped with a meter unless installation of a meter is deemed impractical by the Village Administrator in which case the premises may be serviced with water at a flat rate, determined by the Administrator. In no case shall the flat rate be less than the minimum established rate.
RULE 9. All meters must be set in a horizontal position and at a point on the incoming service pipe as close as possible to the building or foundation wall, on the inside of the building. Such settings must have at all times unobstructed access for the purpose of reading and removal of the meter. Plumbers in planning their work should pay strict attention to this requirement. It is our interpretation that the meter shall be accessible from an outside entrance, so that it will not be necessary for the meter reader to walk through any part of the living quarters in the house, including kitchen, living room, interior hall or bedroom. Builders, plumbers and all others who may install water services are warned that water service will not be provided to premises where this rule and regulation is violated until it is corrected. If there is any question in the mind of builders and plumbers, it is suggested that the Utilities Superintendent be consulted before work is started.
RULE 10. New service meters up to three-fourths inch diameter are classified as domestic meters and are furnished at cost to the consumer. Meters of one inch diameter and larger shall be purchased through the Utility Department by the consumer. All meters of over two inches diameter shall be of the compound indicating type or single turbides type as determined by the Village Administrator. Size of meters shall be determined by the Utility Superintendent.
RULE 11. Each meter of two inches diameter or larger shall be provided with a bypass. The by-pass must be valved so that it can be sealed to prevent its use by any one except the Utility Department personnel.

RULE 12. Meter readings will be taken monthly and as near the same date as practical. If the meter reader is unable to obtain a reading by reason of the meter being out of order, it will be replaced and an estimated charge will be made. If the meter reader is unable to gain entrance to the premises on a first call, the current bill will be estimated. Estimates will be based on previous readings. Water consumption will not be estimated for three monthly billing periods in succession. Water service will be shut off if the meter reader cannot gain entrance after proper notification. The Village Administrator is empowered to require exterior meter reading at property owners expense if accessibility is denied.
RULE 13. Any property owner, firm or corporation, may discontinue water service and the responsibility therefor by giving notice to the main office of the Utility Department. The meter will be removed and the water shut off at the curb by the Utility Department. Discontinuance of service does not eliminate the responsibility to pay the minimum monthly service charge. When a building is again occupied, water will be turned on upon application for service at the Utility Department Billing Office, when the turn-on charge and the payment of the regular advance minimum fee. The Village Administrator is authorized to adjust water bills if it is proven there is unknown leakage and property owner was not notified.
RULE 14. Each meter of a size greater than three-fourths inch shall be provided with a stop waste cock on an inlet and a stop-cock on an outlet. Five-eighths inch and three-fourths inch domestic meters shall have one gate valve in the inlet piping. Such shut-offs shall be readily accessible.

RULE 15. Inspectors, meter readers or employees of the Utility Department whose duty it may be to enter upon private premises to examine meters, pipes or other fixtures used in connection with the Village water supply, shall be equipped with proper credentials, as the Utility Superintendent may deem necessary to identify them as agents of the Utility Department. Such authorized inspectors, meter readers or employees of the Utility Department must have free access at all reasonable hours to all parts of the building for the purpose of inspecting meters, examining fixtures and observing the manner in which the water is used. In case an authorized inspector, meter reader or employee is refused admittance to any premises, or is hindered or prevented from making such examination, the water will be turned off and not turned on again until free access is given.
RULE 16. The Utility Department reserves the right to remove a meter from any premises and substitute another in its place for purposes of testing and repairing.
RULE 17. The Utility Department will on its initiative undertake to test and correct any meter which in its judgment is registering incorrectly, without the consent of any consumer.
RULE 18. Upon written request from an owner or consumer, any five-eighths or three-fourths inch meter will be removed and tested for accuracy at the meter department shop. The test may be made in the presence of the owner or consumer, if requested. If the meter tests with two percent (2%) plus or minus on all streams above twenty gallons per minute and within ten percent (10%) minus on one-half gallon per minute, the established tolerance limits, the meter is functioning properly and a charge of twenty-five dollars ($25.00) will be made for the test. Should the test show the meter registering in favor of the Utility Department, an adjustment will be made in favor of the owner or consumer. If the test shows the meter to be registering in favor of the owner or consumer, the water consumed and not registered will be estimated and charged for accordingly. No charge will be made for the test of meter if the meter is registering incorrectly.

RULE 19. Meters larger than five-eighths by three-fourths inch shall be returned to the manufacturer for testing and repair at the consumer’s expense.
The Village retains ownership of all meters and remote readers. All commercial accounts with water meters 2 inch in size or larger are required to be tested per AWWA recommendation as follows: 2 to 3 inch meters are to be tested every 3 years; 4 to 5 inch meters tested every 2 years; 6 inch meters and larger every year. The property owner will be responsible for contracting at his own expense with a Village approved testing firm. The firm will test for the accuracy of the meter and report in writing to the Public Works Department. Such report is to be received by the Public Works Department no later than May 1, of the appropriate time frame for the above mentioned testing schedule of meter size effective in 2005. (Ord. 20-05.
