No Council member, Mayor or member of the Administration shall be permitted to speak for a longer time than five minutes on any legislation, except that permission to extend may be granted by a majority of the members elected to Council prior to the time the speaker begins to address Council.
(Ord. 342-1990. Passed 12-17-90.)
121.22 ORDER.
If any member, in speaking or otherwise, transgresses the rules of Council, the President of Council shall call the offending member to order. The member so called to order shall immediately yield the floor unless permitted by the Presidents to explain. Any member may, by raising to the point of order, call the attention of the President to such transgression. The point of order shall be decided by the President without debate. Every such decision of the President shall be subject to appeal to Council by any two members.
(Ord. 255-1978. Passed 11-6-78; Ord. 17-2020. Passed 2-18-20.)
121.23 APPEAL.
Any member may appeal to Council from a ruling of the presiding officer, and if the appeal is seconded the member making the appeal may briefly state his or her reason for the same, and the presiding officer may briefly explain his or her ruling, but there shall be no debate on the appeal and no other member shall participate in the discussion. The presiding officer shall then put the question: “Shall the decision of the chair be sustained?” If a majority of the members vote yea, the ruling of the chair is sustained; otherwise it is overruled.
(Ord. 255-1978. Passed 11-6-78.)
121.24 MOTIONS.
Robert's Rules of Order shall govern all motions made on the Council floor.
(Ord. 255-1978. Passed 11-6-78.)
121.25 VOTING.
On the passage of every ordinance or resolution and on the appointment of every officer the vote shall be taken by yeas and nays and entered in full upon the records. On any other question the yeas and nays shall be entered upon the records on the request of any member seconded by any other member. Upon the call of the yeas and nays the Clerk shall call the names and record the vote. Suspension of rules shall be made by a voice vote and recorded if passed unanimously; in the event of a nay vote, however, the Clerk shall call the roll and record the vote.
No member shall speak to an issue once the roll call has begun.
No abstention shall be counted by the Clerk.
No ordinance or resolution shall be enacted without receiving a majority favorable vote of the members present at the meeting unless otherwise required by the Charter.
(Ord. 300-1980. Passed 11-3-80.)
121.26 RIGHT OF FLOOR.
When any member is about to address the Council, he or she shall raise his or her right hand and wait to be recognized by the presiding officer, and when recognized by the chair, the member may remain seated to deliver his or her address and shall confine himself or herself to the question under debate, avoid personalities and refrain from impugning the motives of any other member's argument or vote.
(Ord. 255-1978. Passed 11-6-78.)
121.27 CHANGE OF VOTE.
Before the announcement of the vote on any measure the Clerk shall read the vote so taken upon the demand of any member, at which time any Council member on account of error or for any other reason may change his or her vote. But no Council member shall be permitted to change his or her vote as recorded after the roll call has been verified and the result declared.
