§ 14.295.08 SEVERABILITY.
   If any section, subsection, sentence, clause or phrase of this Division M is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Division M. The City Council hereby declares that it would have adopted this ordinance and each section, subsection, sentences, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.

DIVISION O: SEASONAL SALES/CHRISTMAS TREE SALES
§ 14.314 PURPOSE.
   It is the purpose of this Division O to protect the public health, safety and welfare of the citizens of the city by requiring establishments not otherwise engaged in the business of retail sales to obtain from the city a license for a limited period of time when having a periodic on a retail basis.

§ 14.315 DEFINITIONS.
   The following words and terms, when used in this Division O shall have the following meanings, unless the context clearly indicates otherwise.
   CHRISTMAS TREE SALES. The selling of Christmas or holiday trees at retail in the city.
   SEASONAL SALES. A sale for a period not more than 30 days to be held inside of the building of a or a in any of the zoning districts in the city. Only those items which form the basis of the wholesale or warehouse business may be sold at retail.
   WAREHOUSE ESTABLISHMENT. A warehouse establishment in any of the zoning districts of the city having as its primary purpose the warehousing of goods or merchandise.
   WHOLESALE ESTABLISHMENT. An establishment in the business of wholesaling located in the city as a wholesale establishment having said wholesale business as a primary purpose of the business.

§ 14.316 LICENSE REQUIRED.
   (a)    . No person, firm or corporation shall conduct a in the city without first having obtained a license from the City Fire Marshal, pursuant to this Division O.
   (b)    . No person, firm or corporation shall conduct a without first having obtained a license from the City License Section, pursuant to this Division O.

§ 14.317 LICENSE APPLICATION.
   Licenses shall be applied for not less than 15 days before the sale. Applications for license shall be made in writing and shall specify the following:
   (1)   Name and residence of the applicant and if a corporation the registered office thereof;
   (2)   The name and address of the or for which the is to be held and for which the license is being requested;
   (3)   The name and address of the manager or person responsible for the ;
   (4)   The number of days of the or ; and
   (5)   Such other information as the city shall require.
