1719.02. Application for license.
   Every application for a license provided by this chapter shall be on a form approved by the official charged with the enforcement of this chapter, and shall state the name and address of the applicant, the nature and extent of his interest in the business for which the license is desired, and, if the applicant is not the owner of such business, then the application shall also state the name and address of the owner. Such application shall further state the location of the business, unless the application is for a peddling or vending business, for which the license is desired, together with such other information as may be required by the official charged with the enforcement of this chapter.

1719.03. When order for license may be issued.
   The official charged with the enforcement of this chapter shall issue to the Supervisor of Licenses an order to grant to the applicant an operating license for the conduct of the business described in the application, for which a license is desired, if such business is found, after a thorough investigation, to comply in all respects with the provisions of this chapter and of all laws and ordinances applicable to such business.

1719.04. Issue of order for license without investigation.
   The official charged with the enforcement of this chapter may issue such order, for license without a prior investigation, provided that the applicant for license shall, in writing upon a form approved by such official and signed by such applicant, state that the premises upon which the business for which the license is desired is conducted in compliance with the provisions of this chapter and all of the laws, ordinances applicable to such business and premises.

1719.05. Form of license; fees.
   The Commissioner of the Treasury shall, upon the issuance to him of such orders for licenses, and upon receipt of the license fees hereinafter set forth, issue licenses to the respective applicants. Such license fees for the following respective businesses or occupations shall be, respectively:
   (a)   For persons engaged in the selling of meat or meat products at wholesale to retail dealers, the license fee shall be one hundred twenty-five dollars ($125.00) per annum.
   (b)   For persons engaged in the business of public cold storage and/or refrigeration of food products the license fee shall be one hundred twenty-five dollars ($125.00) per annum, except such places that process food or food products on the premises. The license fee shall be one hundred eighty dollars ($180.00) in the latter instance.
   (c)   For persons engaged in the business of selling poultry and/or eggs at wholesale to retail dealers, the license fees shall be one hundred twenty-five dollars ($125.00) per annum.
   (d)   For each confectionery store, the license fee shall be thirty dollars ($30.00) per annum.
   (e)   For retail food establishments the license fee shall be as follows:
      (1)   Retail food establishments having up to 1,000 square feet of floor space-$40.00 per annum.
      (2)   Retail food establishments having from 1,000 square feet to 5,000 square feet of floor space-$50.00 per annum.
      (3)   Retail food establishments having from 5,000 to 10,000 square feet of floor space-$70.00 per annum.
      (4)   Retail food establishments having from 10,000 or more square feet of floor space-$100.00 per annum.
   (f)   For each wholesale food manufacturer or packer, the license fee shall be one hundred fifty dollars ($150.00) per annum.
   (g)   For each wholesale food and/or frozen dessert storer, the license fee shall be one hundred twenty-five dollars ($125.00) per annum.
   (h)   For each wholesale food and/or frozen dessert distributor, the fee for one unit or distributing vehicle shall be $50.00; for four units or distributing vehicles, $75.00; and for five or more units or distributing vehicles, $125.00; all fees are per annum.
   (i)   For each wholesale frozen dessert manufacturer or packer, the license fee shall be $225.00 per annum.
   (j)   Persons engaged in selling fish and/or seafood products at wholesale to retail dealers, the license fee shall be $125.00 per annum.
   (k)   For each bottling plant, the license fee shall be one hundred fifty dollars ($150.00) per annum excepting those engaged in the exclusive bottling of water, including mineral water, either natural or artificial, for which the license fee shall be one hundred dollars ($100.00) per annum.
   (l)   For each wholesale distributor of baked goods, the annual license fee shall be as follows: Based on the number of distributing units: For one vehicle or other unit, $50.00 per annum; for two vehicles or other units, and not more than four vehicles or other units, $75.00 per annum; for five or more vehicles or other units, $125.00 per annum.
   (m)   For each wholesale storer of baked goods, the annual license fee shall be $125.00.
   (n)   For each manufacturing bakery, the annual fee shall be as follows: Establishments having up to 10,000 square feet, $100.00; and establishments having over 10,000 square feet, $150.00.
   (o)   For each wholesale fruit or produce storer, the annual license fee shall be $125.00.
   (p)   For each wholesale fruit or produce distributor, the license fee shall be as follows: Based on number of distributing units: For one vehicle or other unit, $50.00; for two vehicles or other units and no more than four vehicles or other units, $75.00; for five or more vehicles or other units, $125.00; all per annum.
   (q)   For each wholesale fruit or produce grower and/or packer, the license fee shall be $150.00 per annum.
   (r)   For each wholesale dealer in dairy products in the City, the fee shall be as follows: based on number of distributing units, for one vehicle or other unit, $50.00; for two vehicles or other units, and not more than four vehicles or other units, $75.00; for five or more vehicles or other units $125.00; all per annum.
   (s)   For persons engaged in rendering or reduction of inedible animal substances, and for persons engaged in the collection or gathering of butchers' offal or other animal matter, except hides, skins and pelts, the license fee shall be four hundred seventy-five dollars ($475.00) per annum.

   (t)   A temporary food establishment operation as determined by the official charged with enforcement of this chapter, that operates no longer than fifteen consecutive days a year, shall obtain or renew a license to operate at a fee of thirty dollars ($30.00) per establishment.
   (u)   An operator conducting a festival food establishment, engaged in the selling of food at a single event, in one location, for a period of not longer than five consecutive days a year, shall obtain a license at a fee of thirty dollars ($30.00) prior to the festival event.

   (v)   For vehicular food establishments from which food and/or drink or any substance for human consumption is manufactured, processed, packaged, stored, sold, or offered for sale, the fee for each unit or distributing vehicle shall be $50.00.

1719.06. Record of license.
   The License Supervisor shall keep a public record of all licenses issued under the provisions of this chapter, and a list of such licenses as issued shall be sent to the official charged with the enforcement of this chapter. The original applications shall be kept in the files of the Division of Health.

1719.07. Revocation of license.
   The official charged with the enforcement of the provisions of this chapter shall have the power to revoke any license if the premises upon which the business for which the license is granted is conducted, do not comply in all respects with the provisions of this chapter and with all laws and ordinances applicable to such premises and the use to which they are put, or if any false statements shall be made by the applicant in connection with the issuance of such license, or if the owner of such business, or the agent of the owner shall do anything, or cause anything to be done, or omit to do anything or cause the omission of anything required, or prohibited by this chapter, or by any other law or ordinances relating to such business or such premises.

1719.08. License shall be displayed.
   It shall be unlawful for any person to operate any place in which food is prepared, produced, manufactured, packed, stored or served for sale, or any basket wagon, or other vehicle, hand steamer, street stand from which food is vended or peddled, unless a license duly issued, as hereinbefore provided, shall then be in force, and unless such license shall at all times be displayed in a conspicuous place within the premises where such business is conducted or in the case of a vending or peddling business such license shall at all times be displayed in a conspicuous place on the side of the vehicle, basket, or stand in which such business is conducted, and each day's operation in violation of this section shall constitute a separate offense punishable as herein provided.
