   1713.01. Title; scope.
   (a)   This chapter shall be known and cited as the Toledo Construction and Demolition Debris Disposal Facility Code.
   (b)   This chapter regulates any person or entity that engages in the disposal of construction and/or demolition debris within the City of Toledo, as encompassed by and within the parameters of Revised Code 3714 and as encompassed by the Ohio Administrative Code regulations enacted in furtherance thereof.

1713.02. Definitions.
   (a)   Definitions, terms, phrases and word usage applicable to the enforcement of this chapter are found at Revised Code 3714 and the Ohio Administrative Code regulations enacted in furtherance thereof.
   (b)   "Public nuisance" means any space, building, excavation, location, lot, facility, land, place or site on which or where construction and/or demolition debris is disposed of, at or on and is unlicensed pursuant to this chapter; or whether licensed or not, by reason of the condition in which the same is permitted to be or remain, in its entirety or in any part thereof, shall or may endanger the health, life or property, or cause harm, damage or injury to any person within the City of Toledo in any one or more of the following particulars:
      (1)   By reason of being a menace, threat or hazard to the general health or safety of the community;
      (2)   By reason of being a fire hazard;
      (3)   By reason of being unsafe for occupancy or use in, on, about or around;
      (4)   By reason of lack of maintenance adequate to comply with public health standards;
      (5)   By reason of material placed thereat that caused or is causing seepage or leachate onto adjoining land, waterway, ditches or sewers and/or polluting water or soil;
      (6)   By reason of material placed thereat that caused or is causing emissions, releases, or discharges into the air and/or air pollution; or
      (7)   By reason of material placed thereat that caused or is causing any harm, threat, or adverse public health impact on the community or the environment.

1713.03. License required; operation standards.
   (a)   No person or entity shall establish, conduct, operate, maintain or modify a construction and/or demolition debris disposal facility within the City of Toledo without a license issued for that purpose by the Toledo Health Director, or his/her representative, pursuant to Revised Code Chapter 3714, the Ohio Administrative Code regulations enacted in furtherance thereto; as well as the provisions of this chapter.
   (b)   The standards for licensing, regulating, inspecting, monitoring, operating and/or maintaining a construction and/or demolition debris disposal facility shall be as provided by Revised Code Chapter 3714, the OAC regulations adopted in furtherance thereof, and this chapter; as well as regulations or procedures established by the Director of the Toledo Health Department, or his/her designated representative.
