RESOLUTION NO. 2-65
Directing the Commissioner of Health to implement the issuance of Board of Health Licenses to house trailer parks and to collect all fees as authorized under state statutes and to regulate house trailer parks as required by state laws and regulations.
WHEREAS, the Council of the City of Toledo has by Ordinance No. 11-65 amended Chapter 25 of the Toledo Municipal Code by repealing Article XXVIII thereof as it related to house trailer parks (camps), and
WHEREAS, the State of Ohio has enacted legislation governing the issuing of licenses for house trailer parks and fees to be charged therefor; has established certain standards and has preempted the field, and
WHEREAS, under the authority of the Ohio Revised Code and the Ohio Sanitary Code, the Toledo District Board of Health is the licensor of all house trailer parks located within the City of Toledo, and
WHEREAS, partially through annexations there has come to be located within the jurisdiction of the Toledo District Board of Health a certain number of nonconforming house trailer parks which have or will receive valid licenses for the operation and maintenance of house trailer parks, now, therefore,
Be it resolved by the Toledo District Board of Health that:
SECTION 1. The Commissioner of Health of the City of Toledo is directed to implement the issuance of 1965 Board of Health licenses to house trailer parks having a valid 1964 license, and to collect all fees as authorized under State statutes and to regulate such house trailer parks as required under Regulations 260-290 of the Ohio Sanitary Code, and
SECTION 2. For those house trailer parks located within the City of Toledo proper prior to the effective date of this resolution, and for those house trailer parks that may be added to the City of Toledo through annexations, the Commissioner of Health may waive certain required regulations for house trailer parks as said regulations relate to lot size, layout, construction, but no waiver shall be made as to required regulations that relate to sanitation, safety and operation of house trailer parks, and
SECTION 3. The Commissioner of Health is directed to: (a) issue a Board of Health license for the year 1964 to those approved house trailer parks within the City of Toledo who have not at the time of this resolution received valid 1964 house trailer park licenses, and (b) require all house trailer parks located within the City of Toledo proper at time of this resolution not having 1964 valid licenses on or before January 30, 1965, to conform with State laws and regulations, and
SECTION 4. For the year 1965 only, the application period for obtaining a license to operate and maintain a house trailer park shall be extended to January 30, 1965. On and after February 1, 1965, all new house trailer parks, or changes or additions to existing house trailer parks, or established house trailer parks without a 1964 valid license shall be required to conform with state laws and regulations, and
SECTION 5. This regulation is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this resolution is necessary for the immediate preservation of the public health, safety and welfare.
