Sec. 6-141 Written Notice - Fines.
   a.   Once a condition has been determined to be a nuisance pursuant to Section 6-139, subsection a., written notice shall be given to the owner or occupier of any parcel of real estate constituting or having upon it a nuisance condition under this sub-paragraph. The owner or occupier shall correct the condition within seven (7) days of receipt of this notice. An extension of time may be applied for through the Town Manager but any granting of an extension shall be in the sole discretion of the Town Manager. In the event that the Town Manager declines to grant an extension, then the property owner shall be responsible to correct said nuisance condition within the prescribed seven (7) day period of time. In the event that the owner or occupier fails or refuses to correct the nuisance condition within the prescribed seven (7) day time, that action shall be deemed a violation of these nuisance regulations, as amended from time to time, and a citation may be issued requiring the owner or occupier to appear in the Schererville Town Court on said citation.

   b.   Once a condition has been determined to be a nuisance pursuant to Section 6-139, subsection b., notice shall be given to the owner or occupier of any real estate constituting or having upon it a nuisance condition under this sub-paragraph. The owner or occupier shall immediately correct the condition. In the event that the owner or occupier fails or refuses to correct the nuisance condition immediately, that action shall be deemed in violation of these nuisance regulations, as amended from time to time, and a citation may be issued and served requiring the owner or occupier to appear in the Schererville Town Court on said citation.
   c.   Any person who violates the provisions of this section shall be punished by a fine of not less than one hundred dollars ($100.00) and not more than two hundred fifty dollars ($250.00) for the first offense; five hundred dollars ($500.00) for the second offense; one thousand dollars ($1,000.00) for the third offense; two thousand five hundred dollars ($2,500.00) for the fourth offense; seven thousand five hundred dollars ($7,500.00) for the fifth and subsequent offenses during a twelve (12) month period of time. All fines shall be payable to the Clerk-Treasurer of the Town, or through the Town Court and payable to the Town of Schererville, and deposited to the Town General Fund.
   d.   Each incident that occurs shall constitute and be deemed a separate offense.
   e.   In the event that a violation persists, in addition to the assessment and imposition of fines and penalties, the Town, through its Town Attorney, may proceed to seek injunctive relief to enjoin the nuisance, pursuant to the applicable provisions of I.C. § 36-1-6-4, as amended from time to time, and all other applicable law.
   f.   The Schererville Town Court shall be the court of proper venue and jurisdiction for the enforcement of this ordinance, except for any injunctive relief, which shall be sought through the Lake Circuit Court or Lake Superior Courts.
