Sec. 6-113 Minimum Refuse Requirements. 18
   a.   All refuse to be collected and disposed of from within the Town shall be placed in containers suitable for collection and disposal.
      1.   Garbage shall be placed in containers made of plastic or metal, equipped with suitable handles and tight fitting covers, and plastic garbage bags or similar receptacles. Said containers shall be watertight and of a type approved by the Town with a capacity of not less than twenty (20) gallons and no more than thirty-two (32) gallons. Said containers shall be provided by the household and shall be kept clean, neat, and sanitary at all times.
      2.   Rubbish containers shall be of a kind suitable for securing and holding rubbish and shall be convenient for collection and of such weight as to be handled readily, when filled, by one (1) average man.
      3.   A standard eighteen (18) gallon recycling bin shall be provided by the Town for use by the residents to contain recyclable material.
   b.   1.   All garbage refuse containers shall be placed for collection at ground level on the owner’s property, on or adjacent to the curbing and within the right-of-way of a street or alley to be accessible not more than six (6) feet from the side of the street or alley from which collection is to be made.
      2.   The property owner shall not place such garbage or refuse container or containers for collection at such collection location before 6:00 p.m. the day before scheduled collection, and shall remove same from the collection location before dusk on the day of collection, or as soon thereafter on said collection date as is practical. In no event shall the property owner leave the garbage or refuse container or containers in said collection location overnight on the day of collection if collection has been made as scheduled.
      3.   When the garbage container is not placed for collection on said schedules collection day, as set forth herein, the same shall be placed inside the residential building. Alternatively, a property owner may place the garbage container in a location behind the building line of their residential building. In all instances, a property owner shall provide screening, fencing or covering that effectively screens said container. It is the purpose and intention herein to have placement of garbage containers at residential properties so as to be unobtrusive and not creating negative impact on the residential areas of Schererville, as well as for maintenance and preservation of property values and quality of life in the town for all town residents.
   c.   1.   All recyclable containers shall be placed for collection at ground level on the owner’s property, on or adjacent to the curbing and within the right-of-way of a street or alley to be accessible not more than six (6) feet from the side of the street or alley from which collection is to be made.

It is the purpose and intention herein to have placement of recyclable containers at residential property so as to be unobtrusive and not creating negative impact on the residential areas of Schererville, as well as for maintenance and preservation of property values and quality of life in the Town for all Town residents.
   d.   If there are any requirements in this Article which conflict with this Section, the provisions of this Section shall prevail.
   e.   Any person or property owner violating the provisions of these refuse and recyclable garbage container regulations shall be subject to issuance of citation for such violation and penalties consistent with the general penalty provisions of the Town Code, as amended from time to time. If a violation continues, each day’s violation shall be deemed a separate violation and addressed accordingly.
