GENERAL PROVISIONS
§ 91.01  AUTHORITY TO OPERATE.
   The town may establish, aid, maintain and operate public parks, playgrounds and recreation facilities and programs.

§ 91.02  SOLDIERS AND SAILORS MEMORIAL PARK.
   The Soldier and Sailors Memorial Park, in the town, situated on Lot 36, in Original Plat Addition to the town, shall not, and cannot be used for any purpose other than memorial services.

§ 91.03  DEPARTMENT OF PARKS AND RECREATION.
   (A)   The Department of Parks and Recreation established therein shall have no further authority to perform any act which binds the town nor any powers to establish, maintain, manage or operate any public park of the town.
   (B)   The Town Council shall hereafter have all authority to establish, maintain, manage and operate all public parks of the town.
   (C)   No part of this section shall be interpreted to conflict with federal, state or local laws, and all reasonable efforts should be made to harmonize the same. Should any section or part thereof of this section be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this section as a whole, or any portion thereof other than that portion so declared to be invalid, and for this purpose the provisions of this section are hereby declared to be severable.
