Any driver operating any taxicab licensed by this section who shall have been twice convicted of violating the speed limits prescribed by state law shall be prohibited from operating any taxicab within the city. The license of any vehicle operated by him or her may be revoked or suspended in accordance with this subchapter until a qualified driver shall have been provided.

For the violation of any of the provisions of this subchapter or any city ordinance or any state law regulating the operation and use of taxicabs or motor vehicles in the city and any regulations issued by the Board of Public Works and Safety pursuant to the authority conferred upon that Board by virtue of these provisions or upon the filing of a verified affidavit with that Board that the driver is unfit for any sufficient cause, the City Board of Public Works and Safety may, upon the application filed by any person, or upon the motion of the Board or any of its members, revoke any license issued under the provisions of this subchapter. Upon the filing of any such application or motion, the Clerk of the City Board of Public Works and Safety shall cause that motion to be docketed for hearing before the Board and shall serve a copy of the application or motion on the holder of the license together with a notice of the date set for hearing at least five days prior to the date of the hearing unless the notice is waived in writing by the holder of the license. The Board may revoke the license or may suspend it until a suitable driver for that vehicle is provided. That driver shall not then operate any vehicle for which license is required until, on application duly made to the Board, it shall be determined that the disqualification no longer exists. The revocation of the license shall not occur until the city has conducted a hearing in compliance with I.C. 36-4-5-5.

Any person adversely affected by any order made by the City Board of Public Works and Safety under the provisions of this section may, within 20 days after that order is entered, commence an action in the County Circuit or Superior Court against the Board of Public Works and Safety to vacate or set aside any order on the ground that the order is insufficient, unreasonable, unlawful or procured by fraud or other unlawful methods. Summons shall be issued upon the complaint filed in that action and be served on the Board of Public Works and Safety in the manner now provided by law in civil actions, and the procedure in the trial of the cause shall be the same as in the trial of civil actions.

Any person who violates any of the provisions of this subchapter shall be deemed guilty of an ordinance violation and, upon conviction, shall be fined as set forth in § 10.99.
