§ 115.38 REVOCATION OR SUSPENSION OF LICENSES.
   For the violation of any of the provisions of this subchapter or any city ordinance or any state law regulating the operation and use of taxicabs or motor vehicles in the city and any regulations issued by the Board of Public Works and Safety pursuant to the authority conferred upon that Board by virtue of these provisions or upon the filing of a verified affidavit with that Board that the driver is unfit for any sufficient cause, the City Board of Public Works and Safety may, upon the application filed by any person, or upon the motion of the Board or any of its members, revoke any license issued under the provisions of this subchapter. Upon the filing of any such application or motion, the Clerk of the City Board of Public Works and Safety shall cause that motion to be docketed for hearing before the Board and shall serve a copy of the application or motion on the holder of the license together with a notice of the date set for hearing at least five days prior to the date of the hearing unless the notice is waived in writing by the holder of the license. The Board may revoke the license or may suspend it until a suitable driver for that vehicle is provided. That driver shall not then operate any vehicle for which license is required until, on application duly made to the Board, it shall be determined that the disqualification no longer exists. The revocation of the license shall not occur until the city has conducted a hearing in compliance with I.C. 36-4-5-5.
