A. A "nuisance" is anything which is injurious to health, indecent, offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property. A nuisance may be the subject of an action.
B. A nuisance may include the following:
1. Drug houses and drug dealing as provided in Utah Code Annotated section 78-38-9;
2. Gambling as provided in Utah Code Annotated section 76-10-1101 et seq;
3. Criminal activity committed in concert with two (2) or more persons as provided in Utah Code Annotated section 76-3-203.1;
4. Party houses which frequently create conditions defined in subsection B1 of this section; and
5. Prostitution as provided in Utah Code Annotated section 76-10-1301 et seq. (1999 Code)
The city or the board of health shall cause every nuisance dangerous to health and human life, within its jurisdiction, to be abated. When complaint of such nuisance is made to it, the city or the board of health shall cause the matter to be investigated and shall determine whether or not the alleged nuisance is detrimental to the public health. A. Notification; Order: Whenever the city or the board of health shall determine that a nuisance detrimental to health exists, it shall in writing notify the owner or occupant of the premises where such nuisance may be found, and shall order the abatement or removal pursuant to such order. The city or the board of health may summarily proceed to abate or remove the same, or the city may cause an action to be brought in the name of the state or the city by the city attorney for the abatement of such nuisance.
B. Abatement By City; Recovery Of Costs: In the event the city abates the nuisance, the city may bring suit to recover costs, etc., in an appropriate court.
C. Collection Of Expenses: In the event collection of expenses to abate the nuisance are pursued through the courts, the city shall sue and receive judgment for all expenses of abatement, together with reasonable attorney fees, interest and court costs, and shall execute upon such judgment in the manner provided by law.
