SERVICE STATION: A. A place of business where gasoline or any highly volatile fuels for motor vehicles or internal combustion engines are sold or offered for sale at retail and dispensed into the fuel tanks of such motor vehicles.
B. "Service station" also means and includes a private storage tank where such products are dispensed for motor vehicles or internal combustion engines.
SERVICE STATION WITH CONVENIENCE STORE: A service station that sells at retail prepackaged or ready to eat food and/or beverages in conjunction with such business' sale at retail of gasoline and other volatile fuels; provided, that the gross annual revenue realized by such food and/or beverage sales do not exceed twenty five percent (25%) of that business' total gross annual revenue. It is unlawful to conduct or operate any service station or service station with convenience store in the city without having first obtained a license therefor; provided, that no license shall be issued to an individual until the necessary inspection permits have been acquired from the fire department. The license fee for operating a service station or a service station with convenience store shall be as specified in the fee schedule adopted pursuant to section 5.06.050 of this title. Such fee shall be in lieu of the flammable combustible handlers' fee. (1999 Code)
No such license shall be issued unless the location and equipment to be used fully comply with all the ordinances of the city and the fire prevention code of the national fire prevention association governing the storage and handling of combustible liquids. (1999 Code)
