The temporary license shall specify the location at which the temporary business may be conducted, and no temporary business may be conducted simultaneously by that applicant (or members of his immediate family residing in a common household) at any other location within the city without a separate temporary license for that location. A temporary business license is not required by the following:
A. A vegetable and fruit stand that sells produce grown solely on property owned or leased by the operator of the vegetable and fruit stand and such property is located in the city.
B. Isolated or occasional sales from a private home by a person not regularly engaged in business.
C. Fundraising endeavors conducted by organizations exempt from federal income tax pursuant to 26 United States Code section 501(c)(3) or other bona fide charitable, religious, educational or scientific organizations or endeavors as determined by the mayor. (Ord. 2011-12, 6-16-2011)
Temporary license holders shall comply with all applicable laws and ordinances of the city, and the state governing the operation of its business. In addition, all temporary business licenses shall require prior approval from all appropriate city and/or county departments, including, but not limited to, the fire and health departments, sheriff's office and community development department. All seasonal sales stands, including fireworks stands shall be located only in those zones allowed by title 13, chapter 13.100, "Appendix A", of this code. All fireworks stands shall be located no closer than twenty five feet (25') from any other fireworks stand or any unit used for the storage or dispensing of any flammable substance.
