The Bidwell Park and Playground commission is authorized and empowered under the Charter of the city, to adopt regulatory rules governing all persons using the parks and playgrounds owned by the city which are not in conflict with any other provisions of the Charter of this code. All regulatory rules so adopted, when approved by the city council, by resolution, shall have the same effect as any other provision of this code, and shall be deemed to be a rule or regulation adopted pursuant to the Charter of the city as that term is used in Section 1505 of said charter regarding the criminal effect of a violation of such rule or regulation, provided, however, that the Bidwell Park and Playground commission may specify as to any regulatory rule, a lesser penalty than that provided for in Section 1505 of the Charter; provided, further, that no violation shall be punishable by imprisonment. Said commission may further provide a minimum penalty, not inconsistent with the provisions hereof, or the provisions of said Charter. Said commission may further provide, in addition to the criminal penalties herein referred to, non-criminal sanctions. All regulatory rules so adopted, upon approval by resolution of the city council, shall become effective immediately upon publication in the official newspaper of the city, of a notice, which notice shall be sufficient if it reasonably advises of the adoption of regulatory rules and of the location, and availability of copies thereof. The content of such rules need not be contained in any such notice.

The Bidwell Park and Playground commission may, in its discretion and without council approval, cause all or any part of a roadway within a park or playground of the city to be closed for a special event during a period not exceeding 24 hours in length when the Bidwell Park and Playground commission finds that such closing is necessary for the safety and protection of persons using the roadway during the special event; and
A. The special event is sponsored and conducted by the city; or
B. The special event is sponsored and conducted by a nonprofit association or corporation, and
1. The event is open to all members of the community, and
2. Where fees will be charged for admission to the event or donations will be solicited in the course of the event, the funds obtained by the sponsor from such fees or donations will be used by the sponsor in a manner which contributes to the betterment of the community and its residents.
