(a) Specifications. Each individual from whom garbage, rubbish, tin cans, bottles, ashes and all other refuse is collected is required to furnish his own garbage can or container, which such garbage can or container shall not exceed thirty gallons in capacity. (6-8-82)
No filled container shall exceed seventy-five pounds gross.
No container shall exceed level full.
All garbage cans shall be equipped with a tight fitting cover.
The capacity of such garbage cans shall not exceed seventy-five pounds gross.
All persons from whom garbage is collected shall use light weight containers only, preferably a regulation garbage can, or approved paper garbage container.
In order to protect employees from injuries to hands and wrists, band and home repaired container bottoms will not be permitted.
All unfit for use will be confiscated.

(b) Identification. All containers used for garbage shall be plainly marked by the owners by placing their names on the lid and on the side of such containers in such a way as to remain there permanently.

(c) Placement of Containers at Curbside; Exemptions.
(1) All garbage and refuse, whether for residential or commercial pickup, shall be placed in approved containers at curbside, either on the street fronting a customer or in the alley, or at such other location as may be designated by the City in order to promote efficient collection service.

(2) Senior citizens over the age of sixty-five years, and all individuals who are totally and permanently disabled and who for that reason are physically unable to place their garbage at curbside, shall be exempted from the provisions of this section upon presenting proof of their age or a physician's certificate as their disability.

No two families may share a garbage container in order to split a fee, and if any family does not receive a bill, it is the duty of the householder to report to the City Collector, as he is liable for this fee. Failure to do so shall be unlawful, and a violation of this article.

No person shall bring any garbage or refuse into the City for the purpose of disposing of such garbage or refuse without first arranging with the City Collector and Treasurer for the payment of a garbage fee. (1967 Code Sec. 15-11)
(a) Requisite of Open Dumping Sites. If open dumping is employed for disposal of garbage or refuse, the sites shall be situated so as not to create a nuisance to any person. All sites shall be approved by the City Health Officer and the State Board of Health and shall not create a fire hazard, a breeding ground for rodents or vermin and shall in no way endanger the safety and welfare of any person.
(b) Disposition. As many of the funds collected from garbage and refuse disposal as shall be necessary for the operation, repair and maintenance of all equipment necessary for garbage and refuse collection in the event the City collects and disposes of the garbage itself, or so much of the funds collected from garbage disposal necessary to pay any person to collect and dispose of garbage and refuse shall be so used. The residue of funds accruing from the operation shall be available for such purposes as Council may determine.

In the event of failure on the part of any person to pay the garbage fees assessed against him under this article, the City shall take such action as may be necessary to collect such fees; provided, however, pick up of garbage and refuse shall continue while such fees are being collected by the City. There shall be collected a one-time penalty of fifteen percent (15%) of each garbage bill remaining unpaid more than thirty days after its due date.

(a) Upon request, the City shall review and determine if an additional collection (special pick-up) can be provided by the City. If the City determines a special pick-up is necessary by the City, an additional charge shall be imposed for each special pick-up. The charge for a special pick-up by the City shall be either a minimum of thirty dollars ($30.00) or such higher charge as shall be determined to be appropriate by the City’s Street Superintendent based on the amount or volume of items to be picked up by the City.
(b) The City shall charge a fee of fifteen dollars ($15.00) to pick up and dispose of a Christmas tree.
(c) During certain periods proclaimed by resolution of Council to be general Municipal beautification and clean-up periods those charges contained within this section shall be suspended for that period.
(d) Yard waste: Yard waste is defined as grass, branches, hedge clippings, dirt, leaves, and any organic matter produced on the grounds of the property. Property owners are prohibited from disposing of yard waste with their regular garbage. Yard waste may be reduced to mulch and reapplied to the property or placed in plastic bags and placed at the front curb of the property for special pick-up at a cost of one dollar ($1.00) per thirty gallon bag. The pick-up day(s) will be designated by the Street Superintendent.
