(a) Requisite of Open Dumping Sites. If open dumping is employed for disposal of garbage or refuse, the sites shall be situated so as not to create a nuisance to any person. All sites shall be approved by the City Health Officer and the State Board of Health and shall not create a fire hazard, a breeding ground for rodents or vermin and shall in no way endanger the safety and welfare of any person.
(b) Disposition. As many of the funds collected from garbage and refuse disposal as shall be necessary for the operation, repair and maintenance of all equipment necessary for garbage and refuse collection in the event the City collects and disposes of the garbage itself, or so much of the funds collected from garbage disposal necessary to pay any person to collect and dispose of garbage and refuse shall be so used. The residue of funds accruing from the operation shall be available for such purposes as Council may determine.
