SEC. 307.   MARKING PARKING AREAS.
307.   MARKING PARKING AREAS.No person except duly authorized employees of the City shall paint or mark any street, curbing or sidewalk, or part thereof, with paint or similar substance of the same color or similar color to that used by the City of Waterloo, Iowa, in designating no parking areas, parking limits or traffic lanes.
SEC. 308.   AUTHORITY TO IMPOUND VEHICLES.
308.   AUTHORITY TO IMPOUND VEHICLES.Members of the Police Department are hereby authorized to remove or have removed any abandoned vehicle from a street, public alley or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the City, under the circumstances herein enumerated:
   1.   "Abandoned vehicle" means any of the following:
      a.   A vehicle that has been left unattended on public property for more than 24 hours and lacks current registration plates or two or more wheels or other parts which renders the vehicle totally inoperable. ('96 Rev.--changed from 48 to 24 hours by 76th G.A.--effective 7/1/96)
      b.   A vehicle that has remained illegally parked upon a public street, municipal parking lot, alley or highway for a continuous period of 24 hours or more. ('96 Rev.--changed from 72 to 24 hours by 76th G.A.--effective 7/1/96)
      c.   A vehicle that has been unlawfully parked on private property or has been placed on private property without the consent of the owner or person in control of the property for more than 24 hours.
      d.   A vehicle that has been legally impounded by order of a police authority and has not been reclaimed for a period of ten days.
      e.   Any vehicle parked on the highway determined by police authority to create a hazard to other vehicle traffic.
   2.   When any vehicle has been impounded by the Police Department, the Department shall give notice to owners, lienholder, and other claimants pursuant to Iowa Code §321.89.
   3.   If an abandoned vehicle has not been reclaimed as provided for in State Code, the Department shall have the authority to dispose of abandoned vehicle pursuant to Iowa Code §321.89.
   4.   The owner or driver of any vehicle impounded for a violation of any of the provisions of this Ordinance shall be required to pay the cost of towing and storage.

SEC. 309.   HANDICAPPED PARKING.
309.   HANDICAPPED PARKING.Chapter 321L of the Iowa Code, Handicapped Parking, is hereby adopted by reference, in its entirety. All amendments to Chapter 321L of the Iowa Code shall automatically modify this Code. We are only setting forth the most commonly used sections in this Traffic Code, as follows:
"321L.1 Definitions.
As used in this chapter, unless the context otherwise requires:
   1.   'Business district' means that territory defined by city ordinance as required under section 321L.5.
   2.   'Department' means the state department of transportation.
'Director' means the director of transportation.
   4.   ‘Lifelong disability’ means a disability described under subsection 8 which has been determined to be permanent by a person authorized to provide the statement of disability required by section 321L.2.
   5.   'Persons with disabilities parking permit' means a permit bearing the international symbol of accessibility issued by the department which allows the holder to park in a handicapped parking space, and includes the following:
      a.   A persons with disabilities registration plate issued to or for a handicapped person under section 321.34, subsection 14.
      b.   A persons with disabilities parking sticker affixed to a registration plate issued to a disabled veteran under section 321.166, subsection 6, or to an operator under section 321.34.
      c.   A persons with disabilities removable windshield placard which is a two-sided placard for hanging from the rearview mirror when the motor vehicle is parked in a handicapped parking space.
   6.   'Persons with disabilities parking sign' means a sign which bears the international symbol of accessibility that meets the requirements under section 321L.6.
   7.   'Persons with disabilities parking space' means a parking space, including the access aisle, designated for use by only motor vehicles displaying a handicapped parking permit that meets the requirements of sections 321L.5 and 321L.6.
   8.   'Person with a disability' means a person with a disability that limits or impairs the person's ability to walk. A person shall be considered a person with a disability for purposes of this chapter under the following circumstances:
      a.   The person cannot walk two hundred feet without stopping to rest.
      b.   The person cannot walk without the use of, or assistance from, a brace, cane, crutch, another person, prosthetic device, wheelchair, or other assistive device.
      c.   The person is restricted by lung disease to such an extent that the person's forced expiratory volume for one second, when measured by spirometry, is less than one liter, or the arterial oxygen tension is less than sixty mm/hg on room air at rest.
      d.   The person uses portable oxygen.
      e.   The person has a cardiac condition to the extent that the person's functional limitations are classified in severity as class III or class IV according to standards set by the American heart association.
      f.   The person is severely limited in the person's ability to walk due to an arthritic, neurological, or orthopedic condition.”
"321L.4 Persons with disabilities parking--display and use of parking permit and persons with disabilities identification designation.
   1.   A persons with disabilities parking permit shall be displayed in a motor vehicle as a removable windshield placard or on a vehicle as a plate or sticker as provided in section 321L.2 when being used by a person with a disability, either as an operator or passenger. Each removable windshield placard shall be of uniform design and fabricated of durable material, suitable for display from within the passenger compartment of a motor vehicle, and readily transferable from one vehicle to another. The placard shall only be displayed when the motor vehicle is parked in a persons with disabilities parking space, except as provided in section 321L.2A.
   2.   The use of a persons with disabilities parking space, located on either public or private property as provided in section 321L.5 or 321L.6, by an operator of a vehicle not displaying a persons with disabilities parking permit; by an operator of a vehicle displaying a persons with disabilities parking permit but not being used by a person issued a permit or being transported in accordance with section 321L.2, subsection 1, paragraph "b", or by a vehicle in violation of the rules adopted by the department under section 321L.8, constitutes improper use of a persons with disabilities parking permit, which is a misdemeanor for which a scheduled fine shall be imposed upon the owner, operator, or lessee of the vehicle or the person to whom the persons with disabilities parking permit is issued. The scheduled fine for each violation shall be as established in section 805.8, subsection 2, paragraph ‘c.’” [Note: $200.00 fine] “Proof of conviction of two or more violations involving improper use of a persons with disabilities parking permit is grounds for revocation by the court or the department of the holder's privilege to possess or use the persons with disabilities parking permit.    3.   A peace officer as designated in section 801.4, subsection 11, shall have the authority to and shall enforce the provisions of this section on public and private property."
"321L.9 Reciprocity.
Persons with disabilities parking permits issued lawfully by other states and foreign governmental bodies or their political subdivisions shall be valid persons with disabilities parking permits for nonresidents traveling or visiting in this state."

SEC. 310.   PROHIBITED PARKING DURING SNOW REMOVAL.
310.   PROHIBITED PARKING DURING SNOW REMOVAL.   (a)   Whenever the Mayor, Director of Public Works, or the Director's designee finds on the basis of falling snow, sleet, freezing rain or the forecast of accumulations of snow or ice, that weather conditions have created or are likely to create hazardous road and driving conditions which will impede or are likely to impede movement of fire, health, police, emergency or other vital vehicular traffic, the Mayor, Director of Public Works or the Director's designee may declare that Snow Removal on Priority One streets shall begin and prohibit parking or stopping of vehicles on designated Snow Removal Routes. While the Snow Removal is in effect, no person shall park, abandon or leave unattended any vehicle upon any Priority One Snow Removal Route or portion of such Route, as designated as such by Resolution of the City Council. Each street designated as a Priority One Snow Removal Route by the City Council, shall be marked with signs displaying the words "No Parking During Snow Removal".
   A Snow Removal parking ban shall continue from its proclamation through the duration of the snow or ice storm and until the proper authority issues notice that the Snow Removal on Priority One streets is at an end. The public will be notified via local radio, television and newspaper when Snow Removal begins and is concluded. The parking prohibition on Snow Removal Routes shall not go into effect until two hours after Snow Removal operations have been declared in accordance with this Chapter. Termination of the parking prohibition shall be effective immediately upon the announcement that the Snow Removal on Priority One streets is at an end. (Ord. #3600, 11/7/88)
   (b)   When it is declared that Snow Removal operations are to begin, it shall be unlawful for the driver of any vehicle to impede or block traffic on designated Priority One Snow Removal Routes.
   (c)   Any police officer of the Waterloo Police Department, the Director of Public Works or the Director's designee shall be authorized to cause the towing of vehicles blocking traffic or parking on designated Snow Removal Routes during Snow Removal operations in violation of this Section. The owner of the vehicle shall pay the costs of towing and storage occasioned by the removal of the vehicle as provided herein.
In addition to any police officer of the Waterloo Police Department, the Director of Public Works, the Superintendent of Streets, and the Street Department Foremen shall be authorized to issue parking tickets for violations of Section 310, parking on designated Snow Removal Routes during Snow Removal operations.    (d)   Special Penalty. Anyone violating this parking ban shall be fined Twenty-five Dollars ($25.00) each offense, in addition to the costs of towing and storage.
   (e)   In any proceeding for violation of this Ordinance, the registration plates displayed on a motor vehicle involved in such violation shall constitute in evidence a prima facie presumption that the registered owner of such motor vehicle was the person who parked or placed such motor vehicle at the point where such violation occurred.
   (f)   If any section, provision and part of this Ordinance shall be adjudged invalid, or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

312.   FEES -MONTHLY AND RESERVED RAMP AND LOT PARKINGParking spaces in either parking ramps or parking lots may be used for monthly parking upon payment of the required fee, IN ADVANCE. Upon payment of the required fee a parking sticker shall be issued, and displayed in a prominent location in the window of the vehicle. RAMP PARKERS WILL RECEIVE A PASS CARD THAT WILL REQUIRE A DEPOSIT. The monthly fees for parking spaces are established as follows:
