149.01. Commission created.
   There is hereby created a Health Commission, effective September 4, 1990, to be composed of seven members, who shall be appointed by the Mayor subject to the confirmation of Council. One member shall be an attorney, one member shall be a physician and the others shall be qualified by experience/education to assist the Commission in the performance of its duties. The term of office of the members shall be three years, except that the initial members shall be appointed for staggered terms of one, two or three years; that is, two for 1, two for 2 and three for 3 years respectively. All members shall serve without compensation and hold office until their successors are duly appointed and qualified. Members appointed to fill vacancies shall have the same general qualifications required for their predecessors, and shall be appointed in the same manner for the remainder of the unexpired term of office.

149.02. Organization and meetings.
   The Health Commission shall elect its own chairman, vice chairman, secretary and such other officers as it deems necessary. The Director shall facilitate the work of the Commission and its committees. The Commission may create such committees and subcommittees as it shall deem necessary to carry out the advisory functions of the Commission. It shall prescribe its own rules of procedure and shall keep a record of its meetings and report annually to Council. It shall meet not less than once each quarter at the call of the chairman or the Director.

149.03. Duties.
   The Health Commission, in addition to other duties contained in this chapter or otherwise imposed upon it by any federal, state or local law, shall perform the following duties:
   (a)   Serve in an advisory capacity to the Director on all matters affecting the department and the public health of the City. The Commission shall consult with and advise the Director, but may not direct the conduct of the department. The Commission shall render such periodic written reports and recommendations as it deems necessary to the Director. Public meetings of the Commission may be called by the Director for the consideration of the affairs of the department, and the Director shall be chairman of such meetings.
   (b)   Serve in an advisory capacity to Council and the Mayor on all matters affecting the public health of the City, including, but not limited to: (1) Appointment and evaluation of Director and (2) Establishment of policy regarding priority of budgets, duties and enforcement.
   The Commission shall consult with and advise Council and the Mayor, but may not direct the conduct of the affairs of the City. Public meetings of the Commission may be called by the Commission for the consideration of the public health of the City, and the chairman shall preside at such meetings. The Commission shall render such periodic written reports and recommendations as it deems necessary to the Mayor and Council.
   (c)   Serve in such other capacities and perform such other duties relating to the subject of public health as may be requested by Council.
