Sec. 9-126 Reimbursement Required by Industrial User.
   In order to comply with federal regulations, in the case of federal grant assistance for the construction of waste treatment works, where it has been determined that "industrial users" as defined in Section 9-125, above, or as amended by appropriate federal regulations, are required to reimburse a portion of the federal grant amount allocable to the capital cost of constructing facilities for the treatment of "industrial wastes", rates and charges shall be collected from each industrial user connected to the municipal sewage works or who otherwise discharges sewage, water or liquids, either directly or indirectly, into the municipal waste treatment system, which charges shall be payable as hereinafter provided and shall be in an amount determinable as follows:
   a.   The industrial cost recovery charges for the treatment of industrial wastes shall be based upon the volume of sewage flow billed to industrial users, as determined in accordance with appropriate provisions for determining billed flow included in Ordinance Number 648 B (Rate Ordinance) and the total strength and character of industrial wastes which is introduced into the waste treatment system. The strength and character of industrial wastes shall be measured at the industrial users expense as provided for in Ordinance Number 648B (Rate Ordinance) and furnished to the Town. The owner or industrial user shall furnish a central sampling point available to the Town at all times. In the event that measurement of the strength and character of industrial wastes are not provided to the Town on a timely basis, the measurements of the strength and character of industrial wastes shall be determined by the Town on the basis of a sample, authorized hereunder, to be taken by the Town for the purpose of appropriate billing. The industrial cost recovery rates for the treatment of wastes shall be as follows:
   Measurement

   b.   However, in the event an "industrial user" can and does show to the satisfaction of the Town that a portion of the total monthly billed sewage flow is from sanitary conveniences, then the flow and pollutant loadings to which the industrial cost recovery charge is applied, shall be determined on the basis of net flow and pollutant loadings excluding sanitary conveniences.
   c.   The industrial cost recovery charges for treatment services on or after the effective date as stated in Section 9-116 shall be prepared and billed quarterly.
