Sec. 9-73 System Development Charge.
   a.   In addition to the tap in charges herein above established, each new customer shall be assessed a charge of seven-hundred fifty dollars ($750.00) at the time of connection, which is calculated to be a pro rata portion of the utility's capital costs to develop the system to extend to these new customers, so as not to have those capital costs be an inequitable burden upon existing customers.

   b.   The system development charge rate established by Ord. No. 1257, approved by the Indiana Utility Regulatory Commission thereafter, adopted by the provisions of Ord. No. 1257A, and which was the subject of application to the Indiana Utility Regulatory Commission for verification of legal inclusion and implementation by the Town in said rate ordinance, and as approved by the Order of the Indiana Utility Regulatory Commission dated March 30, 2005, shall be implemented and assessed as approved.

   (c)   The following system development charges are established by Ord. No. 1661, passed June 16, 2006:
