Sec. 8-37 Child Passenger Restraint.
   a.   A person who operates a motor vehicle in which there is a child less than four (4) years of age shall have said child restrained by a child passenger restraint system. However, if it is reasonably determined that the child will not fit in the restraint system, then said child shall be properly fastened and restrained by a safety belt.
   b.   A person who operates a passenger motor vehicle that is equipped with a safety belt meeting the standards stated in the Federal Motor Vehicle Safety Standards Number 208 (49 CFR 571.208) shall have every child at least four (4) years of age but less than twelve (12) years of age properly fastened and restrained by a child passenger restraint system or a safety belt.
   c.   A vehicle may be stopped by the Schererville Police Department to determine compliance with this Section. However, the vehicle, its contents, the operator or a passenger in the vehicle may not be searched or detained solely because of a violation of this Section.
   d.   Any person who shall violate any of the provisions of this Section shall be subject to a minimum penalty in the amount of ninety-five dollars ($95.00).

   e.   All penalties collected by the Schererville Town Court for violation of this section, as referenced above, shall be deposited into the General Fund Court Fines - Child Passenger Restraint.
