Sec. 7-127 Bond Requirements.
   Before any permit shall be issued under the provisions of the preceding section, the applicant shall also execute and file with the Clerk-Treasurer a bond or certified check in the penal sum of five thousand dollars ($5,000.00) with proper surety, conditioned that such obligors will indemnify and save the Town harmless against loss or damage that may be caused by such excavation or that may arise or result therefrom, or from a failure or omission to keep or maintain adequate and proper warning signs, lights or barriers at the site of such excavation, as hereinafter required and further condition that such applicant will backfill and resurface such excavation according to the provisions set forth in Section 13 of Ordinance 353 (Specifications for Construction of Streets, Sidewalks, Curbs, Gutters, etc. for the Town of Schererville, Indiana). 9 Such bond shall also contain a condition that in case an excavation is made by the principal obligor in an emergency when the Clerk-Treasurer's Office is closed, he will apply and pay for the proper permit on the next business day of such Office. All bonds shall be subject to the approval of the Town Council of Schererville, Indiana.
   Said person, persons, partnership, firm or corporation shall further furnish to the Town of Schererville at the time of mailing said application proof of the fact that they are covered by liability insurance in an amount not less than fifty thousand dollars ($50,000.00) for property damage and fifty thousand dollars ($50,000.00) for injury to any one (I) person and three hundred thousand dollars ($300,000.00) for any one accident. Said applicant shall prove to the satisfaction of the Town payment of a premium for said insurance so that the Town will be protected for a period of one (1) year from the date of the completion of the work performed by the applicant within the Town limits.
   Provided, however, that any person, persons, partnership, firm or corporation may file one bond conditioned as above set forth to cover and apply to all work done under this ordinance. A separate permit shall be obtained as herein provided for the making of separate openings or excavations. Immediately upon the filing of said bond as herein provided, The Clerk-Treasurer shall notify the Public Works Director of such fact, and if said application is satisfactory and said bond is sufficient as to form and surety, said Public Works Director shall approve the same by endorsing his approval thereon.
   Provided, however, that at the time of filing said application as herein provided a permit fee in the amount of twenty five dollars ($25.00) shall be paid, which sum shall become a part of the Street Fund of said Town. In the event said application and bond is not approved said sum shall be returned to the applicant.
