Sec. 6-250 Occupancy Regulations.
   a.   It is recognized by this Ordinance that current applicable State law prohibits the occupancy of buildings over the posted maximum occupancy number. In the event that Indiana state law is enacted or amended, it is anticipated that all appropriate enforcement upon prohibited acts will be undertaken by the jurisdictional law enforcement agencies or entities responsible for the same identified in State law.
   b.   The property owner where a commercial business establishment is located shall not allow more persons to occupy the business establishment than as stated on the posted maximum occupancy sign. Any property owner or business occupant of said commercial business establishment who allows more persons to occupy the business than is allowed or permitted by the posted maximum occupancy sign shall be in violation of this Ordinance.
   c.   The property owner and business occupant of said commercial business establishment where a commercial business establishment is located shall post the maximum occupancy sign in a clearly visible location. Any property owner who fails to post the maximum occupancy sign shall be in violation of this Ordinance.
   d.   Upon complaint or random inspection, the Schererville Fire Chief, or designee, or the Schererville Town Police Chief or designee, are authorized to inspect commercial business establishments and businesses to ensure compliance with this Ordinance.
