Sec. 6-237 Possession of Tobacco Products by Minors Prohibited - Penalty. 32
a. A minor is a person considered to be less than eighteen (18) years of age.
b. Any minor within the town boundaries of Schererville, Indiana, shall be prohibited from possessing tobacco or tobacco products, including but not limited to: cigarettes, cigars, chewing tobacco, snuff, and any other derivative from the tobacco plant.
c. It shall not be a defense to this ordinance that the person who possessed the tobacco did not smoke, chew, or otherwise consume the tobacco.
d. It shall not be a defense to this ordinance that the tobacco product possessed by the minor is the property of an adult.
e. The Schererville Police Department shall be authorized to issue a citation for violation of this ordinance in the name of the minor and/or in the name of the minor's custodial parent and/or guardian.
f. Both the minor and custodial parent and/or guardian shall be responsible for any fine imposed by the court in enforcing this statute, and furthermore shall be responsible for court costs.
g. Violation of this ordinance is punishable by a minimum fine of twenty-five dollars ($25.00) and a maximum fine of two thousand five hundred dollars ($2,500.00).
