Sec. 6-190 Fires Prohibited in Railroad Rights-of-Way.
   a.   From and after the legal passage, adoption and publication of this ordinance, it shall be unlawful for any person, firm or corporation to cause to be ignited or initiated any fire whatsoever upon any railroad right-of-way within the Town of Schererville, Lake County, Indiana, for which adequate measures have not been taken prior to igniting or starting said fire to insure that said fire will not spread through or to adjacent or contiguous real property or improvements thereto or foliage growing or situated thereon or cause any damage to personal property of any nature whatsoever located on adjacent or contiguous real property.

   b.   For the purposes of this ordinance, the term "adequate measures" shall be defined as and only deemed to include the appropriate and necessary placement and situation of necessary personnel and fire fighting equipment by the person, firm or corporation starting or igniting such fire to prevent the spread of the same.

   c.   From and after the legal passage, adoption and publication of this ordinance, it shall be unlawful for any person, firm or corporation to permit or allow any fire whatsoever ignited or started upon any railroad right-of-way within the Town of Schererville, Lake County, Indiana to spread or extend to any adjacent or contiguous real property or improvements thereto or foliage growing or situated thereon or to any personal property of any nature whatsoever located on said adjacent or contiguous real property.

   d.   Any person, firm or corporation who shall violate any of the provisions of this ordinance shall, for each and every violation thereof, be guilty of an offense, and upon conviction thereof, shall be fined not less than one dollar ($1.00) nor more than ten dollars ($10.00) for each offense. Each day that a violator permits a violation to exist shall be deemed a separate and distinct offense.
