If in any instance the Unsafe Building Department shall find that it is necessary to take emergency action with reference to unsafe premises in order to protect life, safety, or property, the Unsafe Building Department may cause such action as necessary to protect life, safety, or property to be performed without issuing an order or giving notice.
Such emergency action shall be limited to removing any immediate danger. The cost incurred in taking or having such action taken may be recovered against the persons who have fee interest or life estate interest in the unsafe premises at the time the Unsafe Building Department found it necessary to take emergency action by the filing of a civil action in Lake County Circuit or Superior Court by the Unsafe Building Department. Costs of such justify an action shall not be borne by either the Unsafe Building Department, any other Department of the Town, or the Town of Schererville.
