a. On the trial of any person charged with the violation of the restrictions thus imposed; and in all civil actions oral evidence of the location and content of such signs or markings shall be prima facie evidence of the adoption and application of such restriction by the town authorities (Town Council) and the validity thereof. The town authorities shall upon request by any party in any action at law furnish under seal of the town authorities (Town Clerk-Treasurer) a certified copy of the resolution of the Town Council establishing the restriction in question which shall be accepted by any court as conclusive proof of such designation or determination by the Town Council.
b. Every person found violating this ordinance shall for the first conviction thereof be punished by a fine of not more than fifteen dollars ($15.00); for the second conviction within one (1) year thereafter such person shall be punished by a fine of not more than twenty-five dollars ($25.00); upon a third or subsequent conviction within one (1) year after the first conviction such person shall be punished by a fine of not more than fifty dollars ($50.00).
