a. Failure to register any device, game or machine required to be registered under the terms of this Division shall be considered a violation.
b. Any violation reported to or discovered by the Police Department or any other representative or employee of the Town of Schererville shall be processed as follows:
1. A written notice of failure to register shall be mailed or delivered to the owner or operator of the commercial establishment in which said device, game or machine is located allowing a ten (10) day period from the date of the notice to pay the full one year registration fee regardless whether it occurs prior or after July 1 of any year.
2. If the ten (10) day grace period passes and the registration fee is still not paid, a second notice shall be mailed or delivered to the owner or operator of the commercial establishment in which said game or device or machine is located requiring its immediate removal or payment of double the annual registration fee within five (5) days of the notice.
3. Failure to remove the game, machine or device or failure to pay the double registration fee shall result in a civil penalty of two hundred fifty dollars ($250.00) assessed against the owner of the machine, device or game, the owner of the real estate in which the commercial establishment is located or the owner of the commercial establishment in which the machine, game or device is located or all of the above jointly or singularly. Should the town be required to enforce this penalty in Court, the above named persons or entities shall also be liable for court costs and attorney fees for enforcement which attorneys fees shall not be less than two hundred fifty dollars ($250.00).
c. The civil penalty shall be applicable even though the machine, device or game was eventually removed from the premises during or after the five (5) day notice period.
