Sec. 4-10 Definitions.
   The following definitions shall be applicable for purposes of this division.
   a.   Motorized bicycle - A bicycle with operable petals which may be propelled by human power or by an internal combustion engine or a battery powered motor, or by both, and when powered by an internal combustion engine having a rating of no more than two (2) (2.0) brake horsepower and a cylinder capacity not exceeding fifty (50) cubic centimeters, and automatic transmission, and a maximum design speed of no more than twenty-five (25) miles per hour on a flat surface.
   b.   Owner - A person who holds the legal title of a motorized bicycle or any person renting or leasing a motorized bicycle and having exclusive use thereof for period longer than thirty (30) days, or in the event a motorized bicycle is the subject of an agreement for the conditional vendee or lessee, or in the event the mortgagor thereof, with the right of purchase upon the performance of the conditions stated in the agreement and with an immediate right of possession of a motorized bicycle is entitled to possession, then such conditional vendee or mortgagor shall be deemed to be the owner for the purpose of this division.
   c.   Operate - The word "operate" or any form or tense thereof shall mean to ride in or on, to drive, to use, to put into action, cause to function, or to be in actual physical control of a motorized bicycle as defined herein.
   d.   Persons - Every natural person, firm, co-partnership or corporation or association.
   e.   Pedestrian - Any person afoot.
   f.   Operator - Any person who drives, operates, or is in actual physical control of a bicycle or vehicle defined herein.
   g.   Vehicle - Every device in, upon, or by which any person or property is or may be transported or drawn upon a roadway or highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
