a. There is hereby established the Town Farmers’ Market Special Revenue Non-Reverting Fund, which shall be a special revenue fund under the rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
b. Any monies collected as donations, from event participation and/or registrations fees, as well as appropriations from other Town funds, shall be deposited into the Farmers’ Market Special Revenue Non-Reverting Fund, as well as any and all of the monies that are specifically identified to be used in connection with said designated community event and activities. The Farmers’ Market Special Revenue Non-Reverting Fund shall be initially funded by the Town Cable TV Promotion Fund in the amount of two thousand dollars ($2,000.00) for the purpose of initial setup costs, advertising, and related.
c. The monies deposited into the Farmers’ Market Special Revenue Non-Reverting Fund shall be utilized and expended only to supplement and pay the costs incurred in connection with the planning, coordination and carrying out of the seasonal Farmers’ Market Community Event, and all activities related thereto, as approved and authorized by the Town Council.
d. The following schedule of fees per space shall be charged for participation in the Schererville Farmers’ Market, to-wit:
1. For participation in a minimum of three (3) individual Thursday events, a fee of twenty-five dollars ($25.00) per event shall be charged to each vendor and collected;
2. For participation in five (5) weeks of events, a fee of one hundred twenty dollars ($120.00) per vendor shall be charged to and collected from each vendor as a participation rate in lieu of the minimum session rate referenced herein. This shall include either five (5) Thursdays or four (4) Thursdays and one (1) Sunday;
3. For participation in nine (9) weeks of events, a fee of two hundred dollars ($200.00) per vendor shall be charged to and collected from each vendor as a participation rate in lieu of the minimum session rate referenced herein. This shall include either nine (9) Thursdays or seven (7) Thursdays and two (2) Sundays.
4. For participation in a full season schedule of events, a fee of two hundred thirty eight dollars ($238.00) per vendor shall be charged to and collected from each vendor as a seasonal participation rate in lieu of the individual session rate referenced herein.
5. For participation in only one (1) Sunday event, a fee of fifty dollars ($50.00) per vendor shall be charged to and collected from each vendor as participation rate in lieu of the minimum session rate referenced herein.
6. For participation in four (4) Sunday events only, a fee of one hundred seventy five dollars ($175.00) per vendor shall be charged to and collected from each vendor as a participation rate in lieu of the minimum session rate referenced herein.
7. A produce vendor shall be able to participate in the event at no cost. If the produce vendor attends every event (18 total events), an incentive check for $180.00 shall be issued to that vendor once confirmation of attendance has been received by the Clerk-Treasurer.
(a) “Produce Vendor” shall exclusively sell farm products such as fresh fruits, vegetables, mushrooms, herbs, nuts, eggs, honey, livestock food products (including meat, milk, cheese and dairy products), and seafood.
8. Any and all fees include applicable Indiana State sales tax.
e. For participation in the Schererville Farmers’ Market event or events, each participating vendor shall provide satisfactory proof of insurance, Federal Tax Identification or Social Security Number, and State Tax Identification Number with the payment of the event or seasonal participation fee. Upon collection of any fees herein, the same shall be deposited into the Special Revenue Non-Reverting Fund created hereby, and processed in conformance with applicable law.
f. The Clerk-Treasurer of the Town is authorized and directed to take all appropriate and required steps to establish the Farmers’ Market Special Revenue Non-Reverting Fund in conformance and compliance with all applicable law, as amended from time to time.
g. The Farmers’ Market Special Revenue Non-Reverting Fund shall be established and shall exist as long as the community event or events with which it is associated occurs on at least an annual basis; however, in the event that said designated community event, or substantially similar community event, does not reoccur within one calendar year, the balance of any monies remaining in the Farmers’ Market Special Revenue Non-Reverting Fund for the Schererville Farmers’ Market Community Event activity shall be transferred and receipted to the Town General Fund.
