Sec. 2-419.9 High Intensity Drug Trafficking Area (HIDTA) Program Special Revenue Non-Reverting Fund.
   a.   There is hereby established the Town HIDTA Program Special Revenue Non-Reverting Fund, which shall be a special revenue fund under the rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
   b.   All grant monies issued to the Town, as the fiduciary agent and sponsoring agency for the Lake County, Indiana High Intensity Drug Trafficking Area (HIDTA) Program, shall be deposited into the HIDTA Program Special Revenue Non-Reverting Fund.
   c.   The monies from the ONDCP meant for the Lake County, Indiana HIDTA Program shall be deposited into the HIDTA Program Special Revenue Non-Reverting Fund, and said funds shall be utilized and expended only as permitted and authorized by the rules and regulations of the ONDCP for the Lake County, Indiana HIDTA Program, consistent with the applicable rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
   d.   The Clerk-Treasurer of the Town is authorized and directed to take all appropriate and required steps to establish the HIDTA Program Special Revenue Non-Reverting Fund in conformance and compliance with all applicable law, as amended from time to time.
   e.   The HIDTA Program Special Revenue Non-Reverting Fund shall be established and shall exist as long as the Town continues to act as the fiduciary agent and sponsoring agency for the Lake County, Indiana, High Intensity Drug Trafficking Area (HIDTA) Program. In the event that the Lake County, Indiana HIDTA Program is terminated, or the Town does not continue to act as the fiduciary agent and sponsoring agency for the Lake County, Indiana HIDTA Program, then upon payment of all valid and proper expenses required to be paid and made from the special non-reverting fund, the special non-reverting fund shall be closed, and all funds remaining, if any, shall be transferred to the appropriate agency or authority under the then-applicable rules, regulations or policies of the Office of National Drug Control Policy (ONDCP).
