a. There is hereby established the Town Special Non-Reverting Stormwater Permit Fee Fund, which shall be a special revenue fund under the rules, regulations and requirements of applicable Indiana Law, including the Indiana Code, as amended from time to time, as well as the administrative rules and requirements of the Indiana State Board of Accounts.
b. All stormwater permit fees collected under the Storm Drainage Regulations Control Ordinance of the Town, as amended from time to time, shall be deposited into the Special Non-Reverting Stormwater Permit Fee Fund. The stormwater permit fees collected under the provisions of the Town Storm Drainage Regulations Control Ordinance and deposited into the Special Non-Reverting Stormwater Permit Fee Fund shall be utilized and expended for the administrative review, inspection and documentation reporting purposes set forth in the Storm Drainage Regulations Control Ordinance, as amended from time to time, and no other.
c. The Clerk-Treasurer of the Town is authorized and directed to take all appropriate and required steps to establish the Special Non-Reverting Stormwater Permit Fee Fund in conformance and compliance with all applicable law, as amended from time to time.
