a. There is established for the Town Court of the Town of Schererville, a Special Deferral Program Fee Non-Reverting Fund pursuant to the provisions of Indiana Code, §§ 36-1-3-1, et seq., as amended from time to time.

b. The newly established Special Deferral Program Fee Non-Reverting Fund for the Town Court shall be funded with the monitoring fees paid to the Town Court by the Prosecuting Attorney for the 31st Judicial District of Indiana for the services rendered and provided to the Town Court to the Prosecuting Attorney for monitoring each participant in the deferral program.

c. The Special Deferral Program Fee Non-Reverting Fund established hereby shall be reviewed annually by the Town Council. The funds directed to be deposited into the Special Deferral Program Fee Non-Reverting Fund established hereby shall include fees paid by participants of the Deferral Program, as determined by the Town Court, as well as interest accrued and earned on the account in which said funds are deposited. The funds directed to be deposited into the Special Deferral Program Fee Non-Reverting Fund established hereby shall be utilized for the use of the Town Court for educational seminars for Town Court personnel, for payment of expenses incurred in relationship to the administration of the monitoring of participants in the Deferral Program of the Prosecuting Attorney, or for any related purpose.

d. The Special Deferral Program Fee Non-Reverting Fund established hereby shall continue as a non-reverting fund until or unless amended or repealed by subsequent ordinance. The fund balance maintained in the Special Deferral Program Fee Non-Reverting Fund established hereby shall be non-reverting at the end of each calendar year. In the event that the Special Deferral Program Fee Non-Reverting Fund is repealed, it is no longer utilized or needed for such purposes, the funds within the Special Deferral Program Fee Non-Reverting Fund shall, at that time, be deposited into the General Fund of the Town.
