a. There is established a Supplemental Public Defender Fund for the Schererville Town Court. This Supplemental Public Defender Fund may be used to supplement the provision for court-appointed legal services, and may not be used to replace other funding of court-appointed legal services.

b. The monies deposited in the established Supplemental Public Defender Fund at the end of each year shall not revert to any other fund, but shall continue to remain in the Supplemental Public Defender Fund for the purposes contemplated by law, namely, Public Defender Services, fees, costs, and the like.

c. Monies deposited into the Supplemental Public Defender Fund are those monies which are required to be paid by a defendant at any time during prosecution for a misdemeanor criminal offense once the Town Court makes a finding that such defendant has the ability to pay the costs of representation, and in the manner prescribed by Indiana Code, § 33-9-11.5-6 and § 33-9-11.5-7, as each are amended from time to time. The costs collected may include reasonable attorney's fees in the event a public defender was appointed by the Court. All fees collected hereby shall be deposited into the Supplemental Public Defender Fund established herein.
