Sec. 2-367 Bad Debt/Uncollectible Accounts Receivable Policy.
   a.   In the event that accounts receivable under this ordinance, as amended from time to time, are not paid within the time frame determined by the Town, its agent or designee; the same shall be deemed delinquent. A penalty of the total account receivable bill for Emergency Medical Services shall be attached as delinquent.
   b.   As used in this ordinance, the term "bad debt" shall have the following definition: "a delinquent account receivable, for which the Town, agent or designee of the Town has reasonably and diligently attempted collection, but to which such collection remains unsuccessful.
   c.   The Town, its agent or designee shall prepare a semi-annual schedule of bad debts. The semi-annual schedule shall consist of the following information:
      (1)   All bad debts, which are at least one hundred twenty (120) days delinquent; and
      (2)   Documentation to define why the Town, its agent or designee has determined same to be uncollectible.
   d.   The Town, its agent or designee shall generate a formal report setting forth any and all efforts made to collect bad debts, and that such efforts have been unsuccessful;
   e.   The Town, its agent or designee in said formal report shall state the reasons that the Town, its agent or designee believes it is economically not feasible to pursue further collection measures on the accounts receivable listed as the aforementioned bad debts.
   f.   The semi-annual schedule described in paragraph c. of this ordinance and the formal report described in paragraphs d. and e., listing delinquent accounts, may be declared uncollectible, and the Town by resolution may authorize the Town, its agent or designee to cease further collection procedures after deeming documented accounts as bad debts, and may cause any and all bad debts to be written off.
   g.   This ordinance is intended to satisfy the provisions of the Social Security Administration and Federal Rules and Regulations.
