Sec. 10-284 Professional Fees and Procedures.
   (a)   The professional fees currently charged to the Town of Schererville for engineering and legal services provided for the review of petitions submitted for subdivision approval shall be charged to the Petitioner, and collected as other fees in connection with such Petition as follows:
      1.   The fee charged to the Town of Schererville for engineering services, based upon the current hourly rate, but shall not include the fee charged for attendance at regularly scheduled meetings.
      2.   The fee charged to the Town of Schererville for legal services, based upon the current hourly rate, but shall not include the fee charges for attendance at regularly scheduled meetings.
      3.   Such fees incurred by Petitioners, pursuant to this Ordinance, shall be in addition to any and all other costs and fees currently imposed upon a Petitioner seeking subdivision approval.
      4.   Such fees shall be determined by the Planning and Building Department and shall be submitted to the Petitioner/Developer on a regular periodic basis no more often than monthly.
   The Petitioner/Developer shall be required to pay the fee invoice upon receipt, and not later than thirty (30) days after the date of invoice. All outstanding invoices for fees are required to be paid in full for the next consideration and action by the Plan Commission, Planning and Building Department Staff, or Town Officials. All actions for any application before the Town by a Petitioner/Developer shall be stayed pending payment in full of all outstanding fee invoices.
      5.   The Clerk-Treasurer of the Town of Schererville shall notify the Planning and Zoning Administrator of the payment of fees so collected no later than five (5) days after payment is received.
      6.   All fees so collected by the Town of Schererville shall be paid to the Clerk-Treasurer and placed in the Planning and Building Department Subdivision Review Professional Fee Special Non-Reverting Fund of the Town of Schererville, to be utilized consistent with applicable law and in conformance with the requirements of said fund as established by appropriate ordinance.
      7.   No mylar shall be signed by the appropriate member of the Plan Commission of the Town of Schererville until payment of the aforementioned fees is received by the Clerk-Treasurer of the Town of Schererville.
