Sec. 2-175 Alcohol and Substance Abuse Policy and Testing Procedure Incorporated by Reference.
   a.   The Alcohol and Substance Abuse Policy and Testing Procedure drafted by the Safety Committee of the Town of Schererville and incorporated herein by reference.

   b.   Any and all provisions in conflict with the terms and conditions of said Alcohol and Substance Abuse Policy and Testing Procedure, particularly paragraph C(3) of Section 10.6 of the Personnel Policy are deleted and repealed.

   c.   The Town of Schererville, Lake County, Indiana, Alcohol and Drug Abuse Policy and Testing Procedure is amended as follows:
DISCIPLINARY ACTION
   If an employee tests positive for drugs or alcohol, that employee shall be suspended for a minimum of five (5) days. Thereafter, the employee will not return to work until they successfully pass a drug or alcohol test. The particular test to which the employee must submit v/ill be for the substance upon which they originally tested positive. It shall be the responsibility of the Town Manager to make a determination as to the appropriate discipline for an employee who tests positive for either drug or alcohol use. The five (5) day minimum suspension is mandatory, however, the mere fact that an employee passes a drug or alcohol test, whichever applies in this particular situation, does not mandate his/her return to employment. This is a decision which will be made by the Town Manager.
   If an employee is not terminated upon the first positive test for drugs or alcohol, upon a second positive test within a twenty-four (24) month period of time, the employee shall be terminated immediately.
   A person who tests positive on an alcohol or drug test, is obligated to sign a contract with a state-certified Substance Abuse Professional (SAP). The employee must agree to complete a program recommended by the (SAP), and furthermore, they are to be randomly tested a minimum of six (6) times during the twelve (12) months following their positive test. If more than six (6) tests are deemed necessary by the drug or alcohol counselor, then the employee must submit to whatever random tests are deemed necessary.
   Failure to comply with the aftercare program shall result in immediate termination.
   d.   All other non-conflicting provisions of the Town of Schererville, Lake County, Indiana, Alcohol and Drug Abuse Policy and Testing Procedure shall remain in full force and effect.
